Indictment prepared against former Ataşehir Mayor Battal İlgezdi

An indictment has been filed against Battal İlgezdi for the crime of "misconduct in office in a chain manner," alleging that he failed to implement demolition orders for 7 structures built in violation of building permits during his tenure as Mayor of Ataşehir.

The indictment, prepared by the Anatolian Chief Public Prosecutor's Office Special Crimes Investigation Bureau, includes the report prepared by Ministry of Interior civil inspectors regarding structures in Ataşehir that were in violation of zoning regulations.

The report stated that certain projects in the district that did not comply with building permits were identified, and that it was decided to take action regarding these structures under Article 32 of the Zoning Law, but that the mayor and officials did not implement these decisions.

Following these developments, the Ministry of Interior granted permission for an investigation into İlgezdi and 8 other individuals on the grounds that they had abused their duties. The indictment, which noted that an appeal made to the Council of State during the objection process was rejected, stated that İlgezdi and the other suspects did not implement the demolition decisions taken by the Municipal Council between 2020 and 2022.

The indictment further stated that by failing to remove the structures that violated zoning regulations, the suspects caused public harm.

It was requested that Battal İlgezdi, along with Mahmut Murt, Mehmet Ali Düzova, Sinem Taş, Aysun Gökçen, Cenan Arslan, İlhami Yılmaz, Kalender Özdemir, and Mahmut Benli, be tried for the crime of "misconduct in office in a chain manner," facing prison sentences ranging from 10 months to 3 years and 6 months. The indictment has been sent to the Anatolian Criminal Court of First Instance for evaluation.
