Inheritance dispute in Menzil taken to court: Ruling issued for Buhara Houses

One of the aspects of the ongoing inheritance dispute between brothers in the Menzil community that has been taken to the judiciary is the Buhara Houses, located in the village of Göçeri in the Kahta district of Adıyaman. The complex, which consists of 41 blocks, has become the center of a legal conflict within the scope of the ongoing lawsuits.

It was reported that there are a total of 1,004 apartments in the complex, with 876 of these units built as 2+1, 120 as 3+1, and 8 as 4+1. The process regarding the management of the Buhara Houses has been among the significant topics of the inheritance dispute within the community.

ALLEGATION OF FORGED SIGNATURES ENTERED THE FILE

According to information reported by Cumhuriyet, a dispute arose between Saki Elhüseyni and Mübarek and Fettah Elhüseyni regarding the management of the Buhara Houses. It was stated that the management was at one point held by the Serhendi Foundation, to which Saki Elhüseyni is affiliated, and later passed to the Semerkand Foundation, which is the group of Mübarek Elhüseyni.

It was noted that the Serhendi Foundation group filed a lawsuit alleging that this management change was carried out using "forged signatures." In the lawsuit filed, it was claimed that the management change was irregular.

MANAGEMENT PASSED TO SERHENDI WITH COURT OF CASSATION RULING

Following a judicial process that lasted approximately two years, the 5th Civil Chamber of the Court of Cassation issued its ruling on December 20. It was recorded that with the decision, the management of the Buhara Houses was transferred back to the Serhendi Foundation.

Following the decision, it was reported that a new chairman and vice-chairman of the board of directors were appointed by the S.S. Buhara Houses Real Estate Management Cooperative, and the first board meeting was held after this decision.

ALLEGATION THAT DOCUMENTS AND LEDGERS WERE NOT HANDED OVER

According to the information obtained, it was alleged that the previous management, which was removed from office, did not hand over the necessary information, documents, and ledgers belonging to the cooperative to the new management. It was stated that upon the determination of this situation, the new board of directors took action.

DECISION MADE TO FILE CRIMINAL COMPLAINT

It was reported that the new board of directors decided to file a criminal complaint against the former board members on the grounds that the information and documents were not handed over. It was stated that legal proceedings regarding the process would be initiated.
