In the "Newborn Gang" trial being heard at the Bakırköy 22nd High Criminal Court, which involves cases of infant deaths, the prosecutor issued significant instructions regarding the course of the trial. In the case where 47 defendants are being tried, the prosecutor requested the arrest of 10 nurses and doctors, and criminal complaints were also brought to the agenda.

It was requested that criminal complaints be filed against Silivri Kolan Hospital Manager Bener Mansuroğlu and Çorlu Reyap Hospital responsible manager İbrahim Oktay for various crimes. Additionally, the prosecutor requested criminal complaints regarding medical negligence that led to infant deaths.

THE COURT WILL RENDER ITS DECISION TODAY

In yesterday's hearing, the defendants' defenses and the statements of the complainants were taken. During the 7-hour session, the prosecutor submitted requests for evidence collection and witness testimony. The hearing was adjourned until 09:30 today to hear the statements of the defense attorneys. The court panel is expected to announce its interim decision following this session.

FORENSIC MEDICINE REPORT REQUESTED FOR THE STATUS OF DECEASED INFANTS

The prosecutor requested that a report be obtained from the Council of Forensic Medicine regarding the deceased infants. Once all statements and evidence are collected, more detailed examinations regarding the deaths are planned. Furthermore, the examination of the defendants' bank account activity records and digital materials, as well as obtaining information from the Social Security Institution (SGK) regarding irregular transactions carried out on the dates of the crimes, were among the requested procedures.

JUDICIAL PROCESS CONTINUES

The public prosecutor, while presenting the arrest requests, which represent one of the critical stages of the trial, stated that detailed examinations must be conducted regarding all defendants.

Following Public Prosecutor Kadir Kocakaya's announcement of his opinion yesterday, the defense attorneys for the defendants will continue to be heard today. Subsequently, an interim decision is expected to be issued following the panel's evaluation.

14 SUSPECTS TAKEN INTO CUSTODY

The Istanbul Police Department announced that a total of 14 people, including five doctors, three nurses, five healthcare workers, and one civilian, have been taken into custody as part of the Newborn Gang investigation.

DETERMINED TO HAVE ACTED IN CONCERT WITH Fırat Sarı

In the statement issued by the Istanbul Police Department regarding the 14 individuals detained in the Newborn Gang trial, the following was noted: As a result of ongoing efforts, it was determined that (16) additional suspect individuals, who acted in concert with the organization leader Fırat Sarı, were involved in criminal activities.

2 SUSPECTS AT LARGE

While 14 of the 16 suspects identified as acting in concert with Fırat Sarı, who is accused of being the leader of the Newborn Gang, were taken into custody, it was stated that one person is a fugitive abroad and another is being sought abroad.

Four of the defendants whose arrest was requested yesterday as part of the Newborn Gang investigation were not present in court today.

It has emerged that Serenay Şenkalaycı, a nurse at Private Avcılar Hospital who was being tried without arrest in the Newborn Gang case and for whom the prosecutor requested detention in yesterday's opinion, is a fugitive as part of a new operation.

The Newborn Gang trial continues on its 13th day with the defense statements of the defendants' lawyers.

The names taken into custody among the suspects for whom trial prosecutor Kadir Kocakaya requested a criminal complaint be filed yesterday are:

Fırat Sarı's phone has been taken for examination; we request an investigation into his phone and WhatsApp records, specifically regarding the sale of the drug Curosurf, to verify that he reported the names, surnames, and national ID numbers of Hasan Basri and Hakan Doğukan to the police.

We request reports on how many patient transfers were made from 112 emergency services and public hospitals to private hospitals.

The investigating prosecutor has collected evidence against the defendants but has failed to collect evidence in their favor.

I do not accept that there is any organization, nor that I am the leader of such an organization.

The attorney for Deniz Korkmaz, in whose name the GMZ company was opened by Fırat Sarı and who filed the CİMER complaint, stated:

“Because of this complaint filed by Deniz, nothing will ever be the same again. From now on, institutions, doctors, and nurses will be much more careful when approaching babies and children. They will not be able to see them merely as a source of money. My client is different from the other defendants. While the other defendants are not here of their own free will, my client is here of his own volition. Had he not filed that complaint, he would be walking free outside right now.”

My client's name does not appear anywhere in the expert report or the inspection report, and no crime allegedly committed by my client has been identified. There is no accusation from the prosecutor's office regarding infant death. In the absence of any crime, it was claimed that my client was directed by the police, resorting to conspiracy theories about the parka he wore and similar matters. If the police or the prosecutor's office were going to conduct an operation, they would have done what was necessary without the need for such a complaint.

The Minister of Health said, 'We dismantled the gang with a CİMER complaint.' It is thanks to Deniz, who made that complaint, that all these events have come to light. If my client, Deniz Korkmaz, had not filed that CİMER complaint, or even if he hadn't pressed the send button after writing it, this trial would not be taking place here today. As a result of this trial, the problematic individuals within the healthcare system, those who see children as money, will be punished. And no one will dare to attempt such wrongs again. I am proud to defend the person who caused this to be ensured.

We do not expect him to be given a plaque for causing everything to be revealed at this stage, but we at least request his release.”

Hüseyin Gündüz’s lawyer is speaking:

“I listened carefully to the video where the prosecutor was threatened. It is already stated there, ‘This matter will come out from you anyway, we have already settled this in Bakırköy.’ I am putting myself in your shoes now. If I were to issue a release order for someone, I would be under suspicion. May God grant you ease; I hope that what is in your hearts will be reflected in your pens with all your courage. I hope you do not make decisions contrary to what is in your hearts.”

“We have no intention of dragging this into a political arena. From the very beginning, I have been speaking of a defect in intent. All these hospitals will be sold to the biggest ones, and everyone in this courtroom will be saddened. Everyone, including everyone in this room, will be very sorry years from now. I am speaking on behalf of my own client; I am defending a victim.”

“THE FORMER PRIME MINISTER TRIED TO CREATE A POLITICAL MOTIVE”

Aydın Mantar, lawyer for doctor İlker Gönen, who is accused of being the second-in-command of the organization:

"A deputy came on behalf of the Future Party, and the former prime minister also came.

I want to start with the Süleymaniye investigation. The former prime minister tried to derive a political motive for himself from there, through these people.

That file is the case in which Merih Çetinkaya was tried. She did not receive any sentence and continues her duty. However, my client was subjected to this slander from the podium of the Ministry of Health in this regard as well."

I will have a few questions; perhaps you are the ones who should be asking them.

The presiding judge announced that he would deliver his interim ruling today.

“I would also like to say this regarding the Ministry of Health's request to join the case: In this country, whenever forests burn, the village shepherd is arrested. Then hotels are built in their place. I believe it is understood what I mean by this.”

The court's interim decision was announced at the end of the 13th day of the Newborn Gang trial.

It was decided that the detention of the 22 imprisoned defendants will continue, and 7 of the 25 defendants currently being tried without arrest were ordered to be taken into custody.

The second hearing of the trial will take place on January 13, 2025.
