Is Cevheri Güven’s mole a journalist?

In the trial of police officer Serkan Dinçer, who serves at the Ankara Narcotics Branch and is accused of leaking information and documents to the fugitive Cevheri Güven—who is involved in the "FETÖ" media structure—along with three police chiefs who conducted the Bora Kaplan operation; it has been claimed that it was not these defendants, but a journalist named S.K. who sent the statements of Bora Kaplan, who was sentenced to 68 years in prison on charges of being a criminal organization leader, to Cevheri Güven.

In the hearing held on July 11 at the Ankara 17th High Criminal Court, the prosecutor, who presented his opinion on the merits, requested that the detained defendant Serkan Dinçer be sentenced to 10 years for membership in an organization, and that former Ankara Deputy Police Chief Murat Çelik, former Organized Crime Branch (KOM) Manager Kerem Gökay Öner, and Deputy KOM Branch Manager Şevket Demircan be sentenced to up to 5 years in prison for "breach of confidentiality and misconduct in office."

PRESIDING JUDGE CHANGED, NEW INVESTIGATION BEGUN

It was expected that the defendants would present their defenses against the opinion on the merits and that a verdict would be reached at today's session. However, it was observed that the Presiding Judge had changed. The new Presiding Judge stated, "The opinion on the merits has been submitted. We will not take defenses in this session. We have other investigations to conduct. After that," before proceeding to hear a witness and take requests from the defendants and their lawyers.

Before relaying the testimony of witness A.S., let us note the following.

According to the indictment, an individual named M.O. reported to the Muğla 112 emergency line that police officer A.S., who is stationed in Milas, was a close friend of Serkan Dinçer, who allegedly leaked information and documents to Cevheri Güven.

Police officer A.S., who was heard at the hearing on May 15, stated that he did not know Serkan Dinçer or the other defendants, that the person who made the report, M.O., was the former fiancé of his sister A.S., that he constantly made baseless reports about them, that he had undergone investigations because of him and was cleared of all of them, and that ultimately, as a result of his complaints, M.O. was sentenced to prison.

M.O., who was heard via SEGBİS from the prison where he is being held after A.S., stated that he did not know the defendants, while claiming he learned from his former fiancé that Serkan Dinçer had met with A.S., and asked regarding Dinçer, "Is he an insurance agent?"

Following these testimonies, the Court decided to hear M.O.'s former fiancé, A.S. However, when it was understood that someone else with a similar name had been brought to the July 11 hearing, a writ was sent to the Police Department to locate the real A.S.

The real A.S., who was heard at today's hearing, stated that she had to change her name due to M.O.'s harassment and threats, which is why she could not be found, and explained that she did not know any of the defendants, that she was an adversary of M.O., and that she had never heard the name Serkan Dinçer from her brother.

LAWYER FOUND IT VIA VPN

As the hearing continued, the Prosecutor stated that there was no change in his opinion on the merits and requested that Serkan Dinçer remain in detention.

When asked for his statement regarding the opinion, Serkan Dinçer reminded the court that he had been detained for 23 months and requested his release and acquittal, while Suna Öztaşdöndüren, the lawyer for former KOM Branch Manager Kerem Gökay Öner, argued that all reports were in her client's favor and requested an immediate acquittal.

Deniz Dilşad Güldenoğlu, the lawyer for former Ankara Deputy Police Chief and Police Chief Inspector Murat Çelik, announced that she had found who sent Bora Kaplan's statements to Cevheri Güven and had submitted this to the file with evidence, stating the following:

"This person is a journalist named S.K. On September 13, he tagged Cevheri Güven via VPN and sent the important pages of the statement. The next day, Cevheri Güven published them. I thought the Prosecutor would change his opinion when he saw these documents, but he did not. Furthermore, there are fingerprints on the file containing the statement sent to Cevheri Güven. Whoever those fingerprints belong to is the one who took and sent it. We obtained an expert report. You should also obtain a report."

Murat Çelik's other lawyer, Ahmet Ulukanlıgil, stated that the only reason his client was being tried here was the Bora Kaplan operation, adding, "It is heartbreaking for someone who has spent his life fighting FETÖ to be tried in such a case. Requesting his punishment is a disgrace; it cannot be explained by reason, conscience, or law."

Recep Öksüz, the lawyer for one of the defendants, former Deputy KOM Branch Manager Şevket Demircan, spoke as follows:

"The only reason for this case is that they conducted the operation against the Ayhan Bora Kaplan criminal organization. The file was prepared under pressure from Bora Kaplan. We filed a complaint against the prosecutor who prepared the file, and he has already left anyway. It is clearly evident that someone else leaked the statement to Cevheri Güven. The Ayhan Bora Kaplan organization is a powerful organization with police, judicial, political, and international branches. This criminal organization member had a prosecutor girlfriend in the courthouse."

After the statements were completed, the Court issued a 10-point interim decision to conduct research on various issues, along with the continuation of Serkan Dinçer's detention. The Presiding Judge said that defenses against the opinion on the merits would be taken after the results of these are received.

Meanwhile, Lawyer Recep Öksüz requested an early date for the next hearing, stating, "Our clients are on duty. Their reputations are being constantly assassinated."

The hearing was adjourned to November 4.

OBSCENE IMAGES

On the other hand, it emerged that the Ankara Police Department had sent an interesting letter to the Ankara 17th High Criminal Court.

In the letter dated July 25, it was stated that there were obscene images assessed to belong to Serkan Dinçer within the scope of the investigation conducted into FETÖ/PDY, and it was asked whether the Court had taken any separate judicial action on this matter and whether it had filed a criminal complaint with the Ankara Chief Public Prosecutor's Office.
