Journalist Sinan Burhan evaluated Minister Tunç's striking statements regarding the new regulations in the Penal Execution Law on tv100.

Justice Minister Tunç stated that penalties for crimes such as intentional injury, aggravated injury resulting in death, and threats will be increased, and that the scope of the crime of firing a weapon in a residential area will also be expanded. Blank-firing guns will also be considered within the scope of this crime, with a prison sentence of 1 to 5 years. If the act is committed during events such as weddings, engagements, or military send-offs, the penalty will be increased by half up to one-fold.

PRISON SENTENCE FOR BLOCKING TRAFFIC

According to the new regulation, the penalty for driving under the influence of alcohol or drugs will be increased from 6 months to 2 years. Furthermore, the act of blocking traffic will be defined as a separate crime, and those who commit this crime will be tried with a prison sentence of 1 to 3 years.

NEW REGULATION FOR ORGANIZED CRIME

In line with the Constitutional Court's annulment decision, the elements and penalties for the crime of committing a crime on behalf of an organization without being a member are being redefined. Increases are also foreseen in the penalties for the crimes of establishing, managing, and being a member of an organization.

The lower limit for intentional crimes will be increased from 1 year and 6 months to 3 years; for crimes committed by negligence (excluding negligent homicide), it will be increased from 3 years to 5 years.

HOME CONFINEMENT PERIODS EXTENDED

With the new regulation, the home confinement period for certain special cases is being increased:

For women, children, and individuals over 65, from 1 year to 3 years,

For individuals over 70, from 2 years to 4 years,

For individuals over 75, prison sentences of up to 5 years can be served at home.

For individuals over 80, this period can be extended up to 6 years.

Additionally, the home confinement of prison sentences of up to 5 years due to illness or disability can be extended to 10 years. For sentences given due to childbirth, this period will also be increased from 3 years to 5 years.
