KVKK clarifies points to consider in the processing of Turkish ID numbers

The Personal Data Protection Authority (KVKK) has published the "Guide on the Processing of Turkish Republic (T.C.) Identity Numbers."

The guide addresses the points that must be considered when processing T.C. identity numbers. The KVKK prepared this guide following recent complaints and reports received regarding the processing of T.C. identity numbers.

Some key points highlighted in the guide include:

Importance of Identity Numbers: It is emphasized that identity numbers hold a significant place among personal data and that these numbers provide access to other personal data belonging to individuals.

Processing in Accordance with the Law: It is mandatory for T.C. identity numbers to be processed in accordance with the procedures and principles specified in the Personal Data Protection Law.

Responsibility of Data Controllers: It is stated that data controllers must take the necessary technical and administrative measures while carrying out personal data processing activities.

Use of Less Intrusive Methods: It is emphasized that if methods that are less intrusive to the right to the protection of personal data exist, they should be preferred.

Sector-Specific Provisions: Provisions specific to sectors where identity numbers are processed intensively have been outlined; these sectors include e-commerce, cargo, transportation, electronic communications, insurance, healthcare, the judiciary, public services, and elections.

The guide aims to provide guidance to data controllers in order to ensure the more effective protection of personal data.

The guide also conveyed the importance of data controllers taking the necessary technical and administrative measures to ensure that personal data processing activities are carried out in compliance with the law.

The guide also includes the legislative provisions that serve as a basis for processing operations within the e-commerce, cargo, transportation, electronic communications, insurance, and healthcare sectors, as well as the judiciary, public services, and elections, where it has been determined that identity numbers are processed intensively.
