CHP'S TANAL ALSO ATTENDED
CHP Şanlıurfa Deputy Mahmut Tanal also participated in the march. Speaking to 12punto, Tanal said, "If the lawyers of a country are aggrieved, its citizens are also aggrieved."
Tanal's speech is as follows:
"There are 3 main reasons for the march here. The first is economic reasons, the second is violence against lawyers, and the third is for the judiciary to be impartial and independent.
All lawyers are being attacked during seizures. Why? Is there a remedy or solution for this? Yes, there is. If a seizure cannot be carried out without an enforcement officer, it should not be carried out without a police officer.
If the enforcement officer does not write a request for police assistance, they are responsible. The police station chief who does not provide police is responsible. The police officer who does not go on duty is responsible. If an effective investigation is conducted regarding these matters, these attacks will end.
Regarding economic reasons, the CMK (Code of Criminal Procedure) fees paid to lawyers are all very low, and payments are not made on time. First, taxes are deducted from lawyers, and when they travel to a distant place by car, that fee is already gone. In this sense, these fees need to be regulated as soon as possible.
There are 190 thousand lawyers in Turkey, 50 percent of whom have 0-5 years of seniority, and most of them are young, and most of these young people cannot find work. They cannot even find work for below the minimum wage, and suicides are increasing.
There are 92 law schools here; the education in these 92 law schools is of poor quality, and some of the deans of these law schools are agricultural engineers or civil engineers. Can an agricultural engineer or a civil engineer be a dean of a law school?
Germany is a close example we can compare with, which has the same population as Turkey. We are more or less the same as Germany's population, but the number of law schools is narrow; we have far more than them. In other words, there is no law school in Turkey that is among the top 50 in the world.
The University of Vienna Law School is among the top law schools in the world. Unfortunately, the main view of the lawyers here is for the fundamental rights and freedoms of the citizens. That is, if the lawyer is secure here, the citizen is secure. If the lawyer has rights and freedoms, the citizen has rights and freedoms.
Furthermore, regarding the judiciary and an impartial, independent judiciary, it must be said that if there is no impartial and independent judiciary in a country, there is bribery, there is favoritism, there is injustice, and there is no legal security. The citizen goes and asks, 'Is there a lawyer who can get things done, is there a lawyer who has connections?' What does this lead to? It forces the citizen into bribery.
If you notice, trust and reputation in the judiciary have been shaken in recent years. For trust and reputation in the judiciary to be regained, for justice to be served, and for this order—this bad, corrupt order—to be changed, justice is needed. An impartial, independent judiciary is needed. I exclude the well-intentioned judges and prosecutors in most of the metropolitan cities. Many of them have a relative who is a lawyer. What happens? The work goes to those relatives. When it goes to their relatives, other lawyers are aggrieved. If the lawyers of a country are aggrieved, its citizens are also aggrieved."
