Mahmut Tanal reacts to İrfan Değirmenci and the use of reverse handcuffs: 'An order of torture'
CHP Şanlıurfa MP Mahmut Tanal has reacted to the detention of 43 people, including TİP Party Assembly member İrfan Değirmenci, who were handcuffed behind their backs at Yoğurtçu Park.
Security forces blocked an event that the TİP wanted to organize with its party members at Yoğurtçu Park under the name "TİP is with you in June."
The individuals, who were surrounded by riot police, were taken into custody. Mahmut Tanal reacted to the detentions on his social media account.
Mahmut Tanal's social media post is as follows:
"REVERSE HANDCUFFING IS UNCONSTITUTIONAL!
This practice, which violates the prohibition of torture, is clearly a crime.
Article 17 of the Constitution: No one shall be subjected to torture or ill-treatment.
Article 3 of the ECHR: Inhuman and degrading treatment is prohibited.
Article 93 of the Criminal Procedure Code (CMK): The use of force must be measured and proportionate.
ECHR case law: Reverse handcuffing is considered degrading treatment except in exceptional circumstances!
The use of reverse handcuffs on journalist İrfan Değirmenci and citizens in Kadıköy is;
Unlawful,
Arbitrary,
Constitutes a crime!
Both those who gave this order of torture and those who carried it out will be held accountable before the law.
Freedom of expression and the right to assembly are constitutional rights.
You cannot silence us with pressure and intimidation."
