MHP's Yıldız comments on Covid-19 regulation: 'We are correcting a mistake: we must not make reductions'

MHP Deputy Chairman Feti Yıldız stated regarding the Covid-19 regulation in the Grand National Assembly of Turkey (TBMM): "In previous regulations, there was insistence on taking the date of the crime as the basis, but at that time, the finalization date was taken into account, and the law was passed that way. Now we are correcting this mistake; any point at which we turn back from a mistake is a gain. However, there should be no difference between the previous law and the law we are correcting; in other words, while making a correction, we must not make reductions. All prisons, defendants, witnesses, and their relatives are waiting for this."

MHP's Yıldız comments on Covid-19 regulation: 'We are correcting a mistake: we must not make reductions'

Deliberations have concluded in the Grand National Assembly of Turkey (TBMM) on the Bill on Amendments to the Turkish Penal Code and Certain Laws, publicly known as the "11th Judicial Package". The bill's deliberations have been completed.

Taking the floor on the second part of the bill, İyi Party Antalya Deputy Uğur Poyraz reacted to the content of the proposal and said the following:

"With tax amnesties, social security amnesties, and zoning amnesties every five years, and sentence reductions every three years, you have exaggerated things so much that you have reached the point of discussing the 'right to hope' for the terrorist leader and probation opportunities for terrorists. While your domestic and national crime barons have lived like kings on the proceeds of their crimes during your quarter-century in power, our police, judges, and prosecutors are trying to find housing, educate their children, and feed themselves with salaries that melt away every month. Especially those serving in large cities are in dire straits. While women are being murdered, children are going to sleep hungry, young people are wandering around unemployed, and there is no equality in education, health, or income, and the concept of a social state has become a mechanism of charity under your rule—in short, while the welfare, happiness, and security of society have become a luxury—bringing all the sensitivities regarding our Constitution's principle of equality and cramming them into a sentence reduction is a true example of insensitivity and carelessness.

Is this really the country's only problem, or is it your only concern? Does your political representation duty not cover anyone other than those who commit crimes against individuals and society? In a different order, in a country where economic collapse has not turned into moral collapse and where justice, even if it doesn't flow, can at least trickle, a sentence reduction might have a different meaning—a place where those governing the state can occasionally meet social demands—and could even produce a positive outcome. But in Turkey, as it appears in the nation's mind, sentence reduction has turned into a 'joker' card used every few years by those who have made crime a profession, such as bribery, extortion, theft, fraud, corruption, kidnapping, and assault. With the effect of these 'jokers' you constantly provide, crime in Turkey has transformed from an amateur and occasional incident into a professional occupation; it has reached a point where it can conduct business with its counterparts abroad by establishing a dealership network with dozens of sub-sectors."

Yıldız: We are correcting a mistake; any correction is a gain

MHP İstanbul Deputy Feti Yıldız also Covid provided information regarding the changes made to the regulation. Yıldız also spoke about the process for a 'Terror-Free Turkey'. Here are the highlights from Yıldız's speech:

"A regulation is being made in Article 27, in the provisional Article 10 of the Execution Law, that is, this famous Covid regulation. This regulation has come before twice, meaning it came as 3 plus 5, then it came as 3 plus 3, that is, as probation. Now, again, we have placed new barriers with some pressures; that is, with the amendment made in the 6th paragraph of the article, it is ensured that those who were convicts due to crimes committed on or before July 31, 2023, can benefit from the regulation of transferring to an open penal institution or probation earlier, which convicts in closed penal institutions as of July 31, 2023, can benefit from with this regulation. In previous regulations, there was insistence on taking the date of the crime as the basis, but at that time, the finalization date was taken into account, and the law was passed that way. Now we are correcting this mistake; it is better late than never. However, there should be no difference between the previous law and the law we are correcting; that is, while making a correction, we must not make reductions. All prisons, defendants, witnesses, and their relatives are waiting for this.

Intentional homicide crimes due to crimes committed before July 31, 2023, that is, qualified homicide under Article 82 of the Turkish Penal Code; those committed against descendants, ascendants, children, and women are regulated in paragraphs (d) and (e) of 82/1. Again, crimes against sexual immunity and finally, earthquake-related crimes have been kept as exceptions. Convicts who are in closed penal and correctional institutions and meet the conditions set forth in the paragraph will be able to benefit from this opportunity, and the condition of having been in a correctional institution before will not be sought. Thus, it is aimed that the convict is not negatively affected as a result of delays occurring due to reasons not originating from the convict, and that enforcement justice is ensured, and this will be achieved with this law. It should be noted that if the regulation in the sixth paragraph results in a disadvantage for the convict, no action will be taken in accordance with this paragraph regulation. Again, if the sixth paragraph does not cover the issue, the seventh and eighth paragraphs will also be repealed to ensure compliance with the proposed amendment.

We cannot view the ideal of a Turkey without terrorism and the clearing of the country and the region from terrorism solely through the understanding of security policy. It represents the will to strengthen the foundation of the existence of the modern Turkish state. The process of a Turkey without terrorism cannot prepare the ground for, nor can it be, the production of destructive and ruinous policies directed at the accumulations of the Republic of Turkey, the principles of our republic, and our national unity. We see that some circles have panicked recently, seeing that this process is progressing with great responsibility; they have fallen into a panic. No matter what these circles do, this goal will be realized. The physical and intellectual sabotage they want to carry out will also be fruitless. If violence is systematically applied based on political, ideological, religious, or ethnic reasons, its name is 'terrorism'. The victims of terrorism are not only those directly targeted; there are also psychological victims who are gripped by fear. This issue of terrorism is more or less as old as human history, and these concepts will also be in the coming years, that is, both technology

We, the coordinator friends, have come together under the chairmanship of our Speaker of the Parliament, and we will issue a joint report in the coming days. In this report, we will, of course, highlight the areas where we agree. That is, this country is all of ours, this country is ours; we will keep our democracy alive, we will live as brothers, and we will also remove the obstacles in front of the Turkish nation one one we will clear them. That is, when terrorism ends, economic prosperity, democratic participation, and social solidarity will inevitably increase; all of these. That is, this success will not remain only with the provision of internal security; Turkey's position within the architecture of regional peace will also become much more valuable. Our goal is to strengthen Turkish democracy, respect human rights, end fratricide, remove the shackles from our country's hands and feet, reach the level of contemporary civilization, and make every effort to make it a livable country."
