Minister Gürlek said 'the path to appeal is open', AKP's Tayyar said the opposite: This is considered unlikely
Minister of Justice Akın Gürlek made statements following the court's absolute nullity decision regarding the CHP. While Gürlek stated that the path to appeal is open regarding the decision, AKP member Tayyar offered a different interpretation on his social media account.
Akın Gürlek made the following statements regarding the absolute nullity decision:
For this reason, this decision is one that reinforces our citizens' trust in democracy; it is a decision that shows that democracy's self-protection mechanisms are functioning. A state of law is a state that handles allegations seriously and evaluates them with evidence.
'THE PATH TO APPEAL IS OPEN'
Of course, the path to appeal for this decision is open. The process will continue to operate within the legal order. It is of great importance that everyone respects this process, makes their evaluations within the framework of the law, and carries out their objections within the legal order.
'APPEAL' COMMENT FROM AKP'S TAYYAR
While Minister of Justice Gürlek said that the path to appeal is open regarding the nullity decision, AKP member Tayyar offered a different interpretation and argued that this is not possible with the following words:
"The 36th Civil Chamber of the Ankara Regional Court of Justice, while ending the Özgür Özel era with its absolute nullity decision with injunction, has also effectively eliminated the possibility of an appeal.
Since the authority to appeal belongs to the new CHP Chairman Kılıçdaroğlu, this is considered unlikely.
Therefore, it can be said that the absolute nullity decision has effectively become final."
