New development in the Kobani case
The Kobani case, in which former HDP Co-Chairs Selahattin Demirtaş and Figen Yüksekdağ are also being tried, has moved to the appellate stage. Nuray Özdoğan, one of the lawyers for the case, announced that they will file a petition for the release of the imprisoned politicians within a few days and that the appellate court could issue a release decision.
In the Kobani case, Selahattin Demirtaş was sentenced to 42 years and Figen Yüksekdağ to 32 years and 9 months in prison. After a 13-month wait, the court's reasoned decision, spanning over 32,000 pages, was announced in June. Following this decision, the case file, which was heard at the Ankara 22nd High Criminal Court, was sent to the Ankara Regional Court of Justice.
"THE FIRST ACTION SHOULD BE RELEASE"
Speaking to Ayşegül Başar from Bianet, lawyer Nuray Özdoğan stated that the file has been placed in the processing queue at the appellate court and made the following assessment:
“The first urgent action should actually be the release of those being tried. This case is a file where lawlessness has been revealed at both local and international levels. The ECHR rulings, the call from the Council of Europe, and the warnings regarding Demirtaş are clear. The appellate court should complete the preliminary examination stage in a short time and issue a release decision.”
Özdoğan pointed out that the appellate court also has the authority regarding release:
“This is not only under the authority of the local court. The Criminal Procedure Code is clear; the appellate court can also make a decision regarding release or precautionary measures. Continuing this state of detention would be a major injustice.”
IF THE SENTENCES ARE UPHELD, IT WILL BE MOVED TO THE COURT OF CASSATION
The lawyers will submit their petitions containing the release request in the coming days. The appellate court will announce its decision after examining the file on its merits. If the sentences are upheld, the case file will be moved to the Court of Cassation.
