New development regarding Ogün Samast: 12-year prison sentence requested

The Istanbul Chief Public Prosecutor's Office prepared the indictment, which lists Arat, Delal, Hasrof, Rahil Dink, and Sera Dink Nazarian as complainants, and notes that the Istanbul 14th High Criminal Court had filed a criminal complaint.

HE DESCRIBED THE PROCESS OF THE EVENT

The indictment includes the statement Samast gave to the prosecutor's office on December 5, 2014, in which he stated the following:

"As I wrote in the letter, Yasin first took me to Erhan Tuncel's house. I was playing games on the computer at the house. At that time, there was a kitchen section 3 meters behind where I was, and the kitchen door was open. Erhan and Yasin were talking. I overheard them. When I heard Erhan talking about 'Ramazan Akyürek and Director Fuat,' I turned and listened. Yasin said, 'Then our backs are covered.' When we left the house, I asked Yasin. Yasin said, 'I know Ramazan Akyürek. I know him by name, I know he served as a director in Trabzon, but who is Director Fuat?' I asked. Yasin said to me, 'They are Erhan's acquaintances. We were going to have the other kid do this job. The kid backed out. Erhan got a reference from them, from Director Ramazan. He even said, 'The Istanbul police chief even knows, they are all behind you, think about it, you will be a great hero, if you back out, it will be bad, I will burn you.' As I said before, I said 'okay' again. I asked Yasin, 'How will the event happen?' and Yasin said to me, 'You will shoot directly, this will be your signature.' He also gave me a flag. While I was returning to Trabzon by bus, he said, 'They will pick you up in Samsun; if you are caught here, Director Ramazan will be exposed.'"

The indictment explains that the FETÖ terrorist organization, in line with its ultimate goal of seizing all constitutional institutions of the state, removed bureaucrats and personnel it deemed obstacles to its takeover of the military, civil administration, police, judiciary, and other strategically important public institutions, and replaced them with its own members.

FETÖ CONNECTION EMPHASIZED IN THE INDICTMENT

The indictment describes the strategies the organization followed to seize state institutions, emphasizing that after the Dink murder, the organization first took control of the Istanbul Intelligence Branch, and subsequently used the resources of this branch to initiate the Ergenekon, Balyoz, Ayışığı, Military Espionage, Cizre/Temizöz, Revolutionary Headquarters, Tahşiye, Selam Tevhid, and December 17-25 operations and trials, which led to the process culminating in the treacherous coup attempt of July 15.

The indictment states that while no concrete evidence could be obtained that Ogün Samast was a member of the FETÖ/PDY armed terrorist organization, some evidence collected regarding Samast reveals that he had a certain connection with the organization's managers and members, and that with this connection, Samast acted in line with the interests and goals of the organization during and after committing the Dink murder, together with suspects Tuncay Uzundal, Zeynel Abidin Yavuz, Erhan Tuncel, Yasin Hayal, Ersin Yolcu, and Ahmet İskender.

In the indictment, where Ogün Samast is listed as a 'child driven to crime,' a prison sentence of 7 years and 6 months to 12 years is requested for Samast for the crime of "committing a crime on behalf of an armed terrorist organization without being a member of it."
