Objection filed against Nevzat Bahtiyar's detention
Lawyers for Nevzat Bahtiyar, who was sentenced to 4 years and 6 months in prison for destroying evidence in the case regarding the murder of 8-year-old Narin Güran in Diyarbakır, have filed an objection to their client's detention and requested his release.
In the case concerning the murder of 8-year-old Narin Güran in Diyarbakır, lawyers for Nevzat Bahtiyar, who was sentenced to 4 years and 6 months in prison for "destroying, concealing, or altering criminal evidence," have filed an objection to the decision regarding their client's detention.
Nevzat Bahtiyar’s lawyers, Adnan Ataş and Ali Eryılmaz, submitted a petition to the Diyarbakır 8th High Criminal Court, which conducted the trial, to be forwarded to the Diyarbakır 9th High Criminal Court. The lawyers requested their client's release on grounds such as the fact that evidence has already been collected and there is no concrete evidence of a flight risk.
Lawyer Adnan Ataş stated the following in his petition:
"Given that there is no possibility of evidence being tampered with, no concrete evidence of the client's flight risk, and considering the execution law, it is clear that the detention has taken on the nature of punishment. Since judicial control measures could be considered sufficient, we request that the state of detention be terminated."
Lawyer Ali Eryılmaz, in his petition, included the statement: "It is clear that our client has served a certain portion of his sentence according to the current execution regime. We believe that the necessary conditions for his release have been met."
In the verdict hearing held on December 28, 2024, the Diyarbakır 8th High Criminal Court sentenced the mother, Yüksel Güran, the brother, Enes Güran, and the uncle, Salim Güran, to aggravated life imprisonment for "intentional killing of a child in complicity," while sentencing Nevzat Bahtiyar to 4 years and 6 months in prison for destroying criminal evidence.
