Decision from the Official Gazette for forests: They can be allocated for tourism purposes
With the amendment made to the Regulation on the Allocation of Public Immovables for Tourism Investments, state forests can now also be allocated for tourism purposes.
A change has been made to the Regulation on the Allocation of Public Immovables for Tourism Investments. With the addition made to Article 30-A of the regulation, titled 'Allocation Authority and Other Transactions,' state forests have been included among the areas that the Ministry of Culture and Tourism can allocate for tourism purposes.
According to the report by Hüseyin Gökçe from Ekonomim, based on the amendment made to Article 16, if the entrepreneur fails to fulfill their obligations within the preliminary permit period, except for force majeure and reasons originating from the public sector, the pre-paid preliminary permit fee as well as afforestation and maintenance costs will not be refunded. In the previous version of the regulation, it was stipulated that only the preliminary permit fee would not be refunded.
A provision was added to Article 17 of the regulation, titled 'Final Allocation,' stating that if it is deemed appropriate to convert the facility type into a tourism complex, no additional capacity or floor area ratio (FAR) rights will be granted.
