Oğuz Murat Aci trial begins: Timur Cihantimur will not be able to attend the hearing

The first hearing in the case concerning the accident that occurred in Eyüpsultan on March 1, 2024, which resulted in the death of Oğuz Murat Aci, will be held today. It has been reported that Timur Cihantimur, who was 17 years old at the time of the incident and is alleged to have been driving without a license, will not be present at the hearing because the extradition procedures from the US have not been completed.

FIRST HEARING TO BE HELD IN GAZİOSMANPAŞA

It has been learned that the defendant Timur Cihantimur will not be present at the hearing, which will begin at 13:30 at the Gaziosmanpaşa 4th High Criminal Court, and that some individuals will be heard as "witnesses" within the scope of the case.

ALLEGATIONS OF BEING TAKEN ABROAD AFTER THE ACCIDENT

According to the investigation file, the car driven by Timur Cihantimur struck three ATV-type vehicles parked on the side of the road due to a breakdown while he was driving. 29-year-old Oğuz Murat Aci lost his life in the accident, while other individuals at the scene were injured.

It is alleged that following the accident, Cihantimur's mother, Eylem Tok, along with individuals including his father Bülent Cihantimur, removed her son from the scene and took him abroad.

NOTABLE FINDINGS IN THE INDICTMENT

In the indictment prepared by the Istanbul Chief Public Prosecutor's Office and sent to the Gaziosmanpaşa Chief Public Prosecutor's Office, Oğuz Murat Aci is listed as the "deceased," İbrahim Gümüş and Tahsin Arslan as "victims," Özer Aci as the "complainant," and Şükriye Aci as a "person harmed by the crime." Timur Cihantimur is included in the file as a "child driven to crime."

The indictment states that, based on the damage to the vehicles after the accident and expert evaluations, Timur Cihantimur caused the accident by driving above the legal speed limit, and is therefore primarily at fault. It was stated that the ATV vehicles parked on the side of the road due to a breakdown were partially at fault.

ALCOHOL TEST COULD NOT BE PERFORMED

The indictment notes that an alcohol test could not be performed because Cihantimur left the scene after the incident. It was also stated that there is no driver's license issued in the name of the defendant.

The file also reports that the "S.O.S." system in the car was automatically activated after the accident and called the 112 Emergency Call Center, but the operators were unable to establish communication with those inside the vehicle.

REPORTEDLY DID NOT REDUCE SPEED DESPITE WARNINGS FROM FRIENDS

The indictment states that the speed limit was 30 kilometers, there was no lighting, and the vehicle entered a curve with speed bumps at high speed. According to witness statements, although other vehicles slowed down, Cihantimur performed an overtaking maneuver and continued on his way without reducing his speed, despite warnings from his friends in the car to slow down.

The prosecution assessed that under these conditions, the defendant continued to drive despite being in a position to foresee a potential accident, and caused the accident by striking the ATV vehicles on the side of the road.

UP TO 12 YEARS IN PRISON REQUESTED

In the prepared indictment, a prison sentence of 1 year and 9 months to 12 years was requested for Timur Cihantimur for the crime of "causing death and injury by conscious negligence," taking into account that he was 17 years old at the time of the incident. The file also includes information that a red notice has been issued for Cihantimur and that the extradition process from the US is ongoing.
