Opinion presented in the 'social media conspiracy' case against Muharrem İnce

Some of the defendants who are being tried without arrest and the lawyers for the parties attended the hearing held at the Ankara 35th Criminal Court of First Instance.

During the hearing, the public prosecutor, who presented their opinion on the merits, requested that the court acquit the defendants for certain charges on the grounds that the legal elements of the crimes attributed to them were not met.

The prosecutor requested that the file be sent to the Conciliation Bureau regarding the "crime of defamation committed via the internet or social media" due to the possibility of a change in the legal classification of the crime; that if conciliation negotiations between the defendants and the complainants yield negative results, the defendants be punished separately for the same crime; that the defendants be punished for the crime of "unlawfully obtaining or disseminating personal data" against victims Kerime Oruç and Elif Duman; and that the time they spent in detention be deducted from their sentences.

Announcing its interim decision, the court ruled to send the file to the Conciliation Bureau due to the possibility of a change in the legal classification of some crimes, to accept the excuses of the party attorneys who submitted professional excuses, and to grant time to the party lawyers to prepare their defense against the prosecutor's opinion.

The next hearing will be held on November 13.

FROM THE INDICTMENT

The Ankara Chief Public Prosecutor's Office prepared an indictment against 12 suspects in the investigation regarding the "fake bank receipt created in the name of Memleket Party Chairman Muharrem İnce and Presidential Advisor Maksut Serim."

In the indictment, Muharrem İnce and Maksut Serim were listed as complainants, while Elif Duman and Kerime Oruç were listed as victims.

In the indictment, it is requested that the suspects Arkan G, Ethem G, Gülsün A, Kadir A, Mehmet G, Mehmet Ali C, Murat T, Mustafa Cengiz Ç, Salim Faruk K, Seyfullah T, Tekin A., and Tülün K. be sentenced to between 4 and 9 years and 6 months in prison for the crimes of "knowingly using a forged private document," "unlawfully obtaining or disseminating personal data," and "insult via audio, written, or video message."
