The sentence for an individual who created a fake social media account using another person's information has been upheld.

According to the ruling by the 12th Criminal Chamber of the Court of Cassation, an individual living in Antalya created a fake Facebook account using the photo, first name, last name, and phone number belonging to someone else.

The citizen, who noticed the fake account opened in their name, filed a criminal complaint with the Antalya Chief Public Prosecutor's Office to identify and punish the person responsible.

The user of the fake account, whose identity was determined, appeared before the Alanya 8th Criminal Court of First Instance on charges of "unlawfully providing or obtaining data." During the trial, the court decided to dismiss the case because the complainant withdrew their complaint.

The 11th Criminal Chamber of the Antalya Regional Court of Justice, which reviewed the decision on appeal, overturned the local court's ruling and sentenced the defendant to 2 years and 1 month in prison.

Reviewing the file upon appeal, the 12th Criminal Chamber of the Court of Cassation upheld the 2-year and 1-month prison sentence given to the defendant for the crime of "unlawfully providing or obtaining data."

In its decision, the Chamber stated that, based on the collected evidence, the defendant had committed the crime charged, and indicated that the conviction decision rendered by the appellate court against the defendant was in accordance with the law.
