Prison sentence for former YARSAV president Eminağaoğlu

Ömer Faruk Eminağaoğlu, the founding president of the Union of Judges and Prosecutors, published a list titled 'List of AKP members using ByLock' on his social media account in 2017.

Following this post, a lawsuit was filed against Eminağaoğlu on charges of 'insult and slander' involving a total of 21 people, including AKP ministers of the time, the Speaker of the Grand National Assembly of Turkey (TBMM), and members of parliament.

ACQUITTAL OVERTURNED

The Ankara 11th Criminal Court of First Instance issued an acquittal for Eminağaoğlu during the final hearing held on March 31, 2021.

After the case was taken to the appellate court, the 23rd Criminal Chamber of the Ankara Regional Court of Justice overturned the local court's decision, citing the need for the prosecutor's office to be notified regarding other names on the 60-person list and for the files to be handled together.

SENTENCE ISSUED IN CONSOLIDATED CASE

Following the reversal, the trial of the consolidated files was heard again at the Ankara 11th Criminal Court of First Instance. The court announced its decision on March 27.

In the verdict, it was stated that Eminağaoğlu had committed the crime of 'slander' against the complainants. The defendant was initially sentenced to 1 year and 3 months in prison, which was increased to 1 year, 10 months, and 15 days by applying provisions for chain crimes.

The court did not apply a discretionary reduction due to his attitude and behavior during the trial process. Concluding that Eminağaoğlu had 'no prior criminal record and would not commit a crime again,' the court ruled for the deferment of the announcement of the verdict (HAGB).

VERDICT FOR OTHER DEFENDANT

The other defendant tried in the case, Nejad Kumbasar, was also convicted of the crime of 'slander.' A decision to defer the announcement of the verdict was also made regarding Kumbasar.
