Prison sentence sought for President Erdoğan's former legal advisor İzzet Özgenç: May damage honor, dignity, and reputation
A lawsuit has been filed against Prof. Dr. İzzet Özgenç, a criminal law expert, architect of the Turkish Penal Code, and former legal advisor to AKP Chairman and President Recep Tayyip Erdoğan, due to his remarks regarding former Court of Cassation President Mehmet Akarca.
In the indictment prepared by the Ankara Chief Public Prosecutor's Office, it was alleged that 12 posts made by Özgenç on the social media platform X were "of a nature that could damage the honor, dignity, and reputation" of Akarca.
In this context, Özgenç was charged with "publicly insulting a public official due to their duty."
The prosecution has requested that Prof. Dr. İzzet Özgenç be sentenced to imprisonment ranging from 1 to 2 years.
"AKARCA'S SIGNATURE IS NOT PRESENT"
According to a report by Furkan Karabay from Medyascope, İzzet Özgenç stated in his testimony submitted to the prosecutor's office that his characterizations regarding Mehmet Akarca did not contain any insults, that no act requiring criminal liability could be mentioned, and that the duty of the Court of Cassation President was administrative, not judicial.
Pointing out that the case was opened upon the complaint of the Court of Cassation Presidency, Özgenç said, "An investigation can only be conducted if Mr. Akarca files a personal complaint regarding these statements of mine. However, the complaint in question was made on behalf of the Court of Cassation Presidency, and Mr. Akarca's signature is not present at the bottom."
