Pro-government figures were leaking in advance: The parliamentary question Yılmaz Tunç could not answer

Recently, journalists and institutions close to the government have been sharing information about operations to be launched against the opposition with the public a day in advance, with Türkiye newspaper columnist Cem Küçük leading these names.

Cem Küçük, who previously stated “We are friends with Akın Gürlek,” said in a live broadcast he attended last April, “It is in the documents sent by the prosecutor.” As soon as he finished his sentence, Küçük corrected himself by saying ‘leaked’.

Republican People's Party (CHP) Ankara Deputy Adnan Beker brought the issue to the Grand National Assembly of Turkey (TBMM) and submitted a parliamentary question regarding pro-government journalists making statements about judicial processes concerning detentions and arrests before they occur.

According to the report by Cumhuriyet, Beker, who submitted the parliamentary question to the Speaker of the TBMM for Minister of Justice Yılmaz Tunç to answer, said, “It is concerning that in recent days, journalists known for their proximity to the government have been leaking information to the public in advance regarding investigations and prosecutions that have critical consequences such as detentions, arrests, and the appointment of trustees, before judicial processes are completed and even before the subjects of these processes are aware. Considering that the information is always shared by the same people and always concerns actions against members of opposition parties, it is as clear as day that this cannot be a coincidence or mere foresight. The announcement of matters referred to the judiciary to the public in advance through media outlets, journalists, and commentators close to the executive branch raises justified suspicions that the judiciary is politicized and under the influence of the executive.”

Beker asked how this information was leaked to pro-government journalists and what would be done to protect judicial independence in this regard.

Minister of Justice Yılmaz Tunç, who responded to the motion, defended that the courts are independent and impartial according to the constitution instead of answering the question.

Tunç stated, “There is no information in our ministry regarding the legal grounds and justifications for interim decisions, rulings, and judgments rendered by impartial courts, and the ordinary judicial review, application procedures, and conditions for the aforementioned rulings and judgments belong to the judicial authorities specified in the relevant laws.”

Tunç also noted that the authority to submit legislative proposals regarding the issue in question lies with the deputies.
