Public loss from AKP-run municipality that failed to comply with donation conditions! It will pay nearly 70 million in compensation
The AKP-run Osmangazi Municipality failed to comply with the conditions of a land donation made to it in 2008. The citizen who donated the land filed a lawsuit against the municipality. The court ruled that compensation must be paid to the donor.
The AKP-run Osmangazi Municipality in Bursa failed to comply with the conditions set by a donor who gifted it a plot of land. The municipality, which was sued and lost the case, will be forced to make a payment of millions of liras.
According to a report by İsmail Arı from BirGün, striking information was included in the dissenting report prepared by CHP Council Member Sefa Yılmaz regarding the municipality's Audit Commission Report. According to the report prepared by Yılmaz, a citizen named Osman Odman donated his property in the Küçükbalıklı neighborhood to the Osmangazi Municipality in 2008, "on the condition that it be used in its current form."
MUNICIPALITY CHANGED THE ZONING PLAN OF THE LAND
In 2014, the municipality changed the zoning plan of the donated land, converting it from a recreational area to a sports area. The Osmangazi Athletics Hall was built on this land under a protocol signed with the Ministry of Youth and Sports on February 3, 2014.
Subsequently, the donor, Osman Odman, filed a lawsuit against the Osmangazi Municipality at the Bursa 12th Civil Court of First Instance, stating that the municipality had not complied with the donation conditions. The court ruled that 50 million 192 thousand TL must be paid to Osman Odman with legal interest. Additionally, 4 million 21 thousand TL in litigation costs and attorney fees will also come out of the Osmangazi Municipality's coffers.
"LEGAL ACTION MUST BE TAKEN"
In his report, CHP Council Member Yılmaz stated, "The decision has been appealed. If the decision rendered by the Bursa 12th Civil Court of First Instance becomes final, the Osmangazi Municipality will be forced to pay the plaintiff approximately 60-70 million TL, including legal interest, for this land it received through donation without paying any price. When this donation was received from the citizen, it should have been taken without conditions. If it was to be taken as a conditional donation, there should have been a Council decision. When the decision of the Bursa 12th Civil Court of First Instance becomes final, our municipality will suffer a significant loss. If the decision becomes final, legal action must be taken against those who caused this loss to occur."
