Published in the Official Gazette: Raise in attorney fees! Here is the new tariff...

The new Minimum Attorney Fee Schedule prepared by the Union of Turkish Bar Associations (TBB) has been published in the Official Gazette and has entered into force.

According to the new tariff, the hourly fee for verbal consultation at an attorney's office has been set at 3,500 TL, with 1,500 TL for each subsequent hour; the fee for drafting any kind of petition, notice, warning, or protest is 4,500 TL; the preparation of articles of association, regulations, wills, or foundation deeds is 24,000 TL; and the preparation of a rental agreement is 6,000 TL.

The fee for cases involving the adjustment of loan installments or interest heard in consumer courts has been set at 14,000 TL, while the fee for other cases heard in consumer courts is 15,000 TL. For cases and proceedings followed in tax courts, the fee is 18,000 TL for non-hearing cases and 36,000 TL for cases with hearings.

According to the new tariff, the fee for contract attorneys, whose employment is mandatory in joint-stock companies, has been increased from 15,800 TL to 32,000 TL.

Case fees in civil courts of peace have been raised from 10,700 TL to 18,000 TL. The new fee for cases heard in criminal courts of peace has been determined as 13,500 TL.

The new fee for cases followed in courts of first instance has become 30,000 TL.

PROCEEDINGS REGARDING CHILD CUSTODY

The increase rate determined for cases followed in heavy penal courts and juvenile heavy penal courts has been raised by 61 percent to 48,000 TL.

The attorney fee for matters arising from opposition to the enforcement of court orders and interim injunctions regarding child custody and establishing personal relations with a child has been set at 12,000 TL.

For the follow-up of cases heard in regional courts of justice and regional administrative courts, the fee has been determined as 25,000 TL for cases heard in the first instance, and 16,000 TL for cases with one hearing heard through the appeal process.

AMENDMENT TO ARTICLE 14 OF THE TARIFF

On the other hand, the fifth paragraph of Article 14 of the Minimum Attorney Fee Schedule has been amended as follows: "In the event of the rejection or acceptance of applications such as denials, removal of internet publication content, or objections to administrative fines heard in criminal courts, or upon an objection made to the decision of a court of first instance, if the decision of the court of first instance is overturned, the attorney fee shall be awarded as provided for the work in the first item of the first section of the second part, depending on whether the work is with or without a hearing. However, if the amount of the administrative fine subject to the application is below the fixed fee provided for the work in the first item of the first section of the second part of this Tariff, the attorney fee shall be awarded in the amount of the administrative fine."
