Reaction to the private expert report obtained by the Cihantimur family: 'Deliberately taken incorrectly'

Burak Erden, the lawyer for the family of Oğuz Murat Aci, who lost his life after being struck by a luxury car driven by 17-year-old Timur Cihantimur, the son of author Eylem Tok, on February 2 in Istanbul's Eyüpsultan district, made a statement in front of the Istanbul Courthouse.

In his statement, Erden said that the report obtained and submitted by the lawyers of Timur Cihantimur—who is currently in prison in the US along with his mother Eylem Tok—from a private expert regarding the moment of the incident has no binding authority in the court in Turkey.

'OBTAINED BY TWO PEOPLE CLAIMED TO BE FORENSIC EXPERTS'

Stating that forensic reports have determined that Timur Cihantimur was primarily at fault, Erden said the following in his statement:

"The lawyers for the opposing side, Eylem Tok and Bülent Cihantimur, and for Timur Cihantimur, submitted a private report. This report has no binding authority in court. The expert reports previously submitted by the prosecutor's office and the forensic reports already state very clearly that Timur Cihantimur was primarily at fault. There are several other reports submitted previously, which were presented by engineers; these reports also state very clearly that the vehicle was traveling at a speed between 170-180 km/h, exceeding the maximum speed limit of 30 km/h, and therefore found him at fault, as stated in the expert reports provided by the prosecutor's office. This private report has no significance; it is a report that was deliberately taken incorrectly by two people who are claimed to be forensic experts."

WHAT HAPPENED?

In the private expert report obtained by the Cihantimur family and submitted to the investigation file in the US, it was claimed that Oğuz Murat Aci, who lost his life in the accident, and the 4 people accompanying him were 75 percent primarily at fault in the occurrence of the accident, while it was suggested that the driver, Timur Cihantimur, was only 25 percent at fault.
