Regulation on the lowest pension payment accepted

The Bill on Amendments to Certain Laws and Decree-Law No. 375, which includes increasing the lowest pension payment to 20 thousand TL, has been accepted in the General Assembly of the Grand National Assembly of Turkey (TBMM).

The Bill on Amendments to Certain Laws and Decree-Law No. 375, which includes increasing the lowest pension payment from 16 thousand 881 TL to 20 thousand TL, has been accepted in the General Assembly of the TBMM. According to the proposal, amendments are being made to the Civil Servants Law in line with the Constitutional Court's annulment decision. Accordingly, those who fail any of the basic and preparatory training and internship periods during their candidacy period, those who have received more than one warning and/or reprimand penalty, and those who have received a salary cut or a suspension of step advancement penalty will have their employment terminated upon the proposal of disciplinary supervisors and the approval of the appointing authority. Those whose employment is terminated will be immediately notified by the relevant institutions to the institution where the Public Personnel Information System is located. According to these provisions, those whose employment is terminated, except for health reasons, will not be hired as civil servants for a period of 3 years.

Within the framework of the Constitutional Court's annulment decision, a regulation is being introduced regarding the statute of limitations to be applied in case disciplinary penalties of civil servants are annulled by a court decision. Accordingly, if a disciplinary penalty is not imposed within a maximum of 2 years from the date the acts and situations requiring disciplinary action were committed, the authority to impose a penalty will be subject to the statute of limitations. In case the disciplinary penalty is annulled by a court decision, a new disciplinary penalty may be imposed within the remaining disciplinary statute of limitations from the date the decision reaches the administration, or within 4 months at the latest if the statute of limitations expires or there is less than 3 months remaining, taking into account the justification of the decision.

With the proposal, a regulation is being made regarding the duties of the Ministry of Transport and Infrastructure in the Highway Traffic Law. Accordingly, the Ministry will be authorized to inspect those engaged in shared electric scooter operations and to issue administrative fine reports regarding those responsible for issues deemed contrary to regulations.

The lowest pension payment has risen to 20 thousand liras

With the regulation made in the Social Insurance and General Health Insurance Law through the proposal, the minimum monthly payment amount, which was foreseen as 16 thousand 881 liras on a file basis for those receiving old-age, disability, and death pensions and their beneficiaries, has risen to 20 thousand liras starting from the January 2026 payment period.

With the regulation, the minimum wage employer support has been increased from 1000 liras to 1270 liras starting from January 1, 2026, in order to reduce employers' labor costs, increase employment, and protect registered employment.

With the amendment made to the Law on the Establishment and Broadcasting Services of Radio and Television, media service providers that establish unauthorized transmitters despite having a broadcasting license, or those that continue their broadcasts in accordance with transitional provisions regarding channels and frequencies while broadcasting outside their license type, will be warned by the Supreme Council (RTÜK). Judicial and administrative sanctions will be applied to those who continue unauthorized broadcasting despite the warning.

Natural persons who act contrary to the provision, as well as members of the board of directors and general managers of legal entities, will be punished with imprisonment from one to two years and a judicial fine from one thousand to 5 thousand days. Security measures in the Turkish Penal Code will also be applied to legal entities. Broadcasting devices and facilities that continue to operate without authorization will be sealed and closed by the Supreme Council.

Regulation regarding the Turkey Wealth Fund

In line with the Constitutional Court's annulment decision, a regulation is being made regarding the mechanism of audit procedures and principles to which other companies and funds to be established by the company will be subject, in the Law on the Establishment of the Turkey Wealth Fund Management Joint Stock Company and Amendments to Certain Laws. Other companies to be established by the company, the Turkey Wealth Fund (TVF), and companies or sub-funds established or to be established by them as the majority shareholder, as well as companies, sub-funds, and their affiliates of which they are the founder or of which they own more than half of the capital or participation shares by paying the price, will be subject to independent audit.

The annual financial statements and activities of the company, TVF, or companies or sub-funds established or to be established by them as the majority shareholder, as well as companies, sub-funds, and their affiliates of which they are the founder or of which they own more than half of the capital or participation shares by paying the price, which have passed an independent audit, will be audited within the framework of independent audit standards by at least three central audit personnel specialized in capital markets, finance, economy, fiscal affairs, banking, and development, to be appointed by the President.

The TVF Management Joint Stock Company, TVF, or companies or sub-funds established or to be established by them as the majority shareholder, as well as companies, sub-funds, and their affiliates of which they are the founder or of which they own more than half of the capital or participation shares by paying the price, will be subject to private law provisions. For these, the Turkish Commercial Code and their own special legislation will be applied to the companies, and their own special legislation will be applied to the funds, including the TVF.

The TVF Management Joint Stock Company, TVF, companies or sub-funds established or to be established by them as the majority shareholder, as well as companies, sub-funds, and their affiliates of which they are the founder or of which they own more than half of the capital or participation shares by paying the price, cannot be subjected to legislative provisions, restrictions, and practices concerning public administration or companies, enterprises, undertakings, and institutions where more than half of the capital belongs to the public in administrative and financial matters.

Provided that they are subject to the regulations in the "audit" titled provision of the Law, the provisions of legislation other than the Capital Markets Law, the Law on the Protection of Competition, and Article 12 of Decree-Law No. 631 will not be applied to the TVF, the TVF Management Joint Stock Company, or companies or sub-funds established or to be established by them as the majority shareholder, as well as companies, sub-funds, and their affiliates of which they are the founder or of which they own more than half of the capital or participation shares by paying the price. An amendment is being made to the Istanbul Finance Center Law. Accordingly, a participant certificate will be issued to participants by the management company to operate in the Office area. With the proposal, a regulation is being made regarding the financial, social rights and benefits, and retirement rights of the Cyber Security Deputy President position through the amendment made to Decree-Law No. 375.
