Detained defendant N.B., who performed the electrical and motor installation and assembly of the pool, defended himself at the hearingandstated that he had no involvement in the incident.stated that he had noresponsibility. In 2019, for the pool project,we reached an agreementwith 6 people, including Mr. Ferdi,signed a contract,selected the materials, andcame to anagreement. In June 2020, I delivered Mayor Ferdi's pool filled with water. We handle the electrical currents, pumps, filters, and electronic components. Building inspection firms submit their reports after everything is finished, and if there are any deficiencies or errors, they call and notify us. The electrical and mechanical installation of this pool was approved. In the installation I performed, I placed the motors on a stand so they would not remain underwater. took it upon myself.I routed the cables through a different channel.However, many operations were performed after me.The panel was no longer a panel, itwas ruined, splices were made, and cables were pulled.A few times after I delivered it once or twice,Three weeks later, I gave the basic information to Mr. Ferdi. One of the non-detained defendants, H.A., the owner of the winding company, said, "Anyone can install a pool motor. We repaired the motor in April 2022. Building inspection official H.Ş. stated that the pool received approval from the municipality as an ornamental poolstating that it was outside his area of responsibility, and spoke as follows:spokeas follows:

"As building inspectors, we have projects prepared, and they come to us. We approve them. These projects go to the municipality, and the municipalities grant approval. Construction begins. This pool was approved as adecorative pool, your honor. We inspect the approved projects. Adecorative pool license was obtained from the municipality. I cannot know why it was not connected to the license. Under building inspection legislation, building inspection cannot request a design that is not in the approved projects. "I am an electrical engineer. While the ornamental pool was beingbuilt, I saw a pile of dirt. I don't even know if anything else was donebesides that. I didn't even realize it was a pool. The first time Isaw itwas...there was only soilon it."

"REGARDING THEPOOL" IHAD NO DUTY"

Construction engineer S.K. emphasized that his duties were limited to the rough construction and that he held no responsibility regarding the pool, stating the following as follows:stated:

"Being an auditor means being a controller. Property owners bring the projects, we check, approveor reject them. I am responsible for the foundation, formwork, and concrete parts of the construction. As for thepool... I found out when I was called by the prosecutor'soffice. They told me that 4x8 pools were drawn in front of the 6 villas.They toldme. The electrical installationthere are reports stating that it does not affect it. I do not know exactly what it was made with. Another individual being tried in connection with the incident,M.G., stated that he was a childhood friend of the late Mayor Zeyrek.that they were friends, and that they undertook the project togetherwithout any commercialpurpose. In his statement, M.G. conveyed the following:

"I was friends with the late mayor throughout our middle and high school years. At the end of 2016, I received a phone call, and we spoke at Ferdi Zeyrek's office. A land cost of 2 million liras cameup. My company we took out a 2 million loan through. At the beginning of 2018the projects took shape. Because the deceased was an architectwe asked everything. After construction began, everyone determined their own part. The only point I amaccusedof is the use of my company. I put my hand under the stone. They were my35–40year-old friends, everyI didnot suspect anything. The houses were on the upper side.Since there was no project,it wassketched as a draft on an A4sheet of paper. Who I don't know who drew it, but I saw that draft.I saw it.I am being accused here as a contractor.We did this with 6 friends. Pool operatDefendant Y.Ö. claimed that he was onlyresponsible for the cleaning and measurements of the pool,stating that he had no involvement with the installation and therefore had no fault in the accident. Y.Ö., used the following expressions:

"We are responsible for pool cleaning and maintenance. After he became mayor, I neverspoke with him on the phone"we were doing.I am a pool operator. I only ensured the pool's cleanliness and that the measurements were accurate.I have nothing to do with the plumbing there. I would notify them after finishing my work. I have had a 33-year brotherly relationship with Mayor Ferdi. I was very sad. The incident took place in theeven ing.thearea where we were located and the machine room had a distance between them. Water was flowing all the way outside.I cleaned the pool. He asked, 'Is the motor

working?' I replied, 'It trips when I flip the switch.' I told him that we couldn't do anything at that hour.Since it was a holiday,I saidthat.I specifically stated for the sake of it. There was no problem with the motor while I was cleaning. I knew ofnoelectrical malfunction. We have been doing this work for 20 years. If the circuit breaker trips, the motor has burned out. He himself said that thebreaker tripped. I told himnot to touch it and that we would come during the holiday. I have no fault in the incident that occurred. Defendant A.S. also stated that on the morning of the holiday, he was calleddue to a water leakinside the complex, andthat the malfunction was beyond his expertise, claiminghe had no connection to the pool machine roomor the work performed there.said:

"On the morning of the holiday,A.A. called me. I returned after the prayer.I returned. Therewas a water leak inside,and he wanted me to come. I went because he was responsible for the site.Manual operationthere is a water pump running, we checked that too. When we flipped the switch, it would trip, itwas not working. I said, 'This is beyond me.' The garden pipeswere bursting.During the time I was looking at it, nomalfunctionwas observed.Ferdi BaI have never spoken to the mayor until now.I have no connectionto the pool machine room. Questioning the defendant, Nurcan Zeyrek said, "Ferdi was electrocuted while going down the stairs. If the breaker was off, how did Ferdi get electrocuted? Who turned the breaker back on? My husband shouldn't have been electrocuted if the breaker was off." The defendant maintained that he was certain the breaker was off.
