It has been learned that Kadir Özkaya, who was elected President of the Constitutional Court (AYM), had expressed an opinion in favor of a 'violation' regarding the individual application of Gezi prisoner Can Atalay. On the other hand, it drew attention that Özkaya is not a law school graduate.
Constitutional Court (AYM) President Zühtü Arslan's term is set to expire on April 20, and the presidential election was held today.
Özkaya became the new president of the High Court by securing 9 votes from the 15 members of the Constitutional Court, including the president, thus achieving an absolute majority.
The other presidential candidate, Yusuf Şevki Hakyemez, received 6 votes. Özkaya will serve as president for a 2-year term due to the expiration of his tenure.
It drew attention that Özkaya, a graduate of the Department of Public Administration at Gazi University's Faculty of Economics and Administrative Sciences, is not a law school graduate.

Kadir Özkaya had expressed an opinion in favor of a 'violation' in the individual application of Gezi Case prisoner Can Atalay, who was not released despite being elected as a Hatay deputy from the Workers' Party of Turkey (TİP) and whose parliamentary status was subsequently revoked.
THE FIRST PRESIDENT ELECTED FROM AMONG MEMBERS APPOINTED BY ERDOĞAN
According to a report by Gökçer Tahincioğlu from T24, the new Constitutional Court President Özkaya is also the first member to be elected president from among those appointed to the court by AKP Chairman and President Recep Tayyip Erdoğan.
Özkaya had expressed dissenting opinions in cases such as the Disinformation Law, known as the censorship regulation, and the rights violation application of the Academics for Peace.
