Resul Emrah Şahan's lawyer Hüseyin Ersöz announces: Decision to appoint a trustee to Şişli Municipality taken to court
Hüseyin Ersöz, the lawyer for Şişli Mayor Resul Emrah Şahan, who was arrested and replaced by a trustee following an operation targeting the Istanbul Metropolitan Municipality (İBB), has announced that they have filed a lawsuit to cancel the trustee appointment.
Şişli Mayor Resul Emrah Şahan's arrest and the subsequent decision to appoint a trustee to the municipality have been taken to court.
In a statement on his social media account, Şahan's lawyer Hüseyin Ersöz announced that they have filed an annulment lawsuit at the Istanbul Administrative Court against the Ministry of Interior's suspension decision and the trustee appointment carried out by the Istanbul Governorship.
Ersöz made the following statement on the matter via his social media account:
"Following the arrest warrant issued for Şişli Mayor Resul Emrah Şahan, we have filed an annulment lawsuit at the Istanbul Administrative Court, arguing that the 'suspension from duty' carried out by the Ministry of Interior and the 'appointment of an acting mayor/trustee' made by the Istanbul Governorship are unlawful.
In the lawsuit, we also requested that Articles 45 and 46 of the Municipal Law, which form the basis of the contested actions, be referred to the Constitutional Court for a concrete norm review.
We have stated that these regulations not only create the possibility of a disproportionate interference with the Right to Vote and Stand for Election but also constitute a violation of the separation between central administration and local government as regulated in the Constitution.
Let us note that a similar process is ongoing regarding Esenyurt Mayor Ahmet Özer and that the annulment lawsuit is still pending."
