RTÜK President Şahin's statement on 'Açık Radyo': 'Incorrect and incomplete...'

Broadcasts of Açık Radyo, one of Turkey's most established independent radio stations, were terminated by the order of the Radio and Television Supreme Council (RTÜK). RTÜK President Ebubekir Şahin issued a statement regarding Açık Radyo, whose license has been revoked.

RTÜK President Şahin stated in a post on his social media account, "We do not accept the biased statements targeting our Supreme Council, which revoked the broadcasting license of Açık Radyo in fulfillment of its duties derived from the laws, nor the incorrect and incomplete news reports based on these declarations."

STATEMENT FROM THE SUPREME COUNCIL

In his post, Şahin also included the statement issued by RTÜK regarding the matter.

The statement from RTÜK said, “The terms 'genocide' and 'massacre' were used for the 1915 Events on Açık Radyo, and no attempt at correction was made by the program moderator.

It is clear that the labeling of the Armenian deportation, which holds an important place in Turkish political history, as 'genocide' by certain segments and more so by international public opinion, with an unfair and baseless accusation, does not align with historical realities.

Regarding the broadcasts in question, an administrative fine at the maximum limit and a 5-time program suspension sanction were imposed on the broadcaster by our Supreme Council."

'LICENSE REVOKED FOR CONTINUING BROADCASTS'

However, it was stated that Açık Radyo did not implement the 5-time program suspension sanction despite there being no judicial decision to the contrary and continued its broadcasts, adding, "Upon this, a license revocation decision was made regarding Açık Radyo. The fifth paragraph of Article 32 of Law No. 6112 states, 'In the event that a media service provider whose program broadcasts or broadcasts are suspended for a certain period continues its broadcasts contrary to the requirements of the sanction decision despite the notification of the sanction decision, the broadcasting license shall be revoked.'

As can be seen, the legislator has not granted the Supreme Council any discretion in this matter and has made license revocation mandatory in case the sanction is not implemented.

The broadcaster in question has the right to take the RTÜK decision to the Regional Administrative Court," the statement included.
