Ruling issued for villas provided by Demirören Group: 65 people filed a lawsuit

Demirören Group transferred land to Ziraat Bank in exchange for its loan debt, and a court has now issued a stay of execution in a case filed to cancel the construction permits for the villas built on that land.

The Demirören Group took out a 750 thousand dollar loan from Ziraat Bank 5 years ago to purchase a series of media organizations, including Hürriyet Newspaper. However, struggling to repay the loan in question, the Demirören Group transferred its land in the Kemer Country project located in Göktürk to the bank.

Ziraat Bank decided to develop a real estate project on the land it acquired, which also included golf courses. A revenue-sharing agreement was signed for the development of a project consisting of 313 villas and a residence on the site, in cooperation with TOKİ subsidiary Emlak GYO and Ziraat GYO.

65 PEOPLE FILED A LEGAL COMPLAINT

According to the report by Dinçer Gökçe on Halk TV, Emlak GYO signed a contract with Özyazıcı İnşaat AŞ for the construction of the villas. However, 65 people living in the area where construction began applied to the administrative court, requesting the cancellation of the construction and renovation permits.

In the lawsuit filed against the Eyüpsultan Municipality, the defense presented on behalf of the municipality stated in summary: "The lawsuit was not filed within the legal time limit, and the plaintiffs do not have the right to file this lawsuit. The transactions subject to the lawsuit were carried out in accordance with zoning plans and legal regulations. We request that the lawsuit be dismissed."

ZONING PLANS CANCELLED

According to the source of the report, the Istanbul 8th Administrative Court announced its decision regarding the file on November 8. The court issued a stay of execution for the construction and renovation permits on the grounds that there could be "irreparable damages." It was also emphasized that, as a result of another lawsuit, the Istanbul 12th Administrative Court had cancelled the zoning plans for the region in question on September 25, 2023.

Following the court's decision, the plaintiffs applied to the municipality on November 24, requesting that the villa project built in the area be sealed. The application recalled that the court had stayed the execution of the permit and that the permission granted by the municipality had been suspended by the court decision.

According to the assessment of Attorney Aslı Erdem, "The decision is quite clear. The decision must be implemented immediately. The construction must be sealed. Otherwise, the relevant municipal officials will be committing a crime," she stated.

FAMILIAR NAMES ON THE LIST

Meanwhile, it has emerged that among the 65 people who initiated the lawsuit are names well-known to the general public. Basketball coach Oktay Mahmuti, Hilton Hotels Turkey Country Manager Armin Zerunyan, Prof. Dr. Elif Akpek, actress Zerrin Nişancı, Nazım Kadir Bezmen, Ovi Roditi Gülerşen, and UNESCO Turkey National Commission Committee Member Mergül Kotil were among the 65 names who filed the lawsuit.
