Ruling issued on private school that fired pregnant teacher: Unanimous decision
English teacher D.İ.K., who lives in the Karşıyaka district, claimed that her contract at a private school, where she began working in 2020, was renewed in June 2021 but terminated in August. Stating that she was unfairly dismissed because she was pregnant and that she needed the job, D.İ.K. filed a compensation lawsuit.
The compensation awarded by a local court to an English teacher in İzmir, who claimed she was fired for becoming pregnant, has been upheld as lawful by the appellate court.
PRIVATE SCHOOL TOOK THE MATTER TO COURT
The Karşıyaka 3rd Labor Court partially accepted the case and ruled that a total of 51 thousand 122 Turkish Lira in compensation, including severance, notice pay, penalty clause, and discrimination compensation, be paid to D.İ.K.
The private school's lawyers appealed the decision, arguing that D.İ.K. could not prove her claims, that the salary amount was incorrectly determined, and that the plaintiff's employment contract was terminated for just cause due to the pandemic process and economic crisis conditions.
APPEALS COURT: RIGHT TO COMPENSATION IS LAWFUL
The 3rd Civil Chamber of the İzmir Regional Court of Justice stated that the burden of proof regarding the termination of the employment contract in a manner that does not require compensation lies with the employer.
The Chamber stated that it reached the conclusion that the appeals against the first-instance court's decision should be rejected on their merits, based on the evidence in the file, the existence of new hires, the lack of any written document or evidence presented by the defendant party indicating that the contract would be terminated in advance, previous period records, the plaintiff's health reports, and the state of evidence in the concrete file.
The decision, reached unanimously, has become final.
