Russian company building Akkuyu faces enforcement proceedings!
It has emerged that the Russian company TSM Construction, which is building the Akkuyu Nuclear Power Plant, has not paid its debts and is consequently facing enforcement proceedings. An Istanbul-based company that did not receive payment for a machine it sent to the firm has filed a request for a precautionary attachment.
It has emerged that there are a series of enforcement proceedings and lawsuits with requests for precautionary attachment against TSM Enerji İnşaat Sanayi Limited Şti., the main contractor for the last 4 years at the Akkuyu Nuclear Power Plant, which is Turkey's first nuclear power plant.
According to a report by Dinçer Gökçe from HalkTV, a contract was signed on November 1 between W. Yüzey İşlem Makine Endüstriyel Ürünler Şirketi, which operates in İkitelli, Istanbul, and TSM Construction.
The parties reached an agreement on the sale of an ARC vehicle spray coating machine. The machine, valued at 20 thousand 340 dollars, was prepared by the W. Yüzey İşlem company.
TRANSPORT COMPANY DELIVERED TO MERSIN
On November 7, the company forwarded the electronic invoice to TSM Construction. The company's accounting department saw the invoice. On November 7, the W. Yüzey İşlem company also delivered the machine to the Gebze center of the transport company that would carry the machine to Mersin. The machine was delivered to TSM Construction personnel on November 9.
CONTACTED COMPANY OFFICIAL
With the smooth delivery of the machine and the issuance of the invoice, W. Yüzey İşlem began waiting for payment to be made. A few days later, contact was made with M. A. T., a TSM Construction employee involved in the purchase of the machine. Following the message sent to him, M. A. T. included 5 of his colleagues from the company in the messaging system and asked for the creditor party to be informed regarding the payment.
''PAYMENT WILL BE MADE''
However, there was still no development regarding the payment. This time, a phone call was made with TSM Construction employee M. Ö. In response to a message sent on January 12, 2024, M. Ö. replied, "Hello, I checked, it has been processed into the system, there is no problem, it is among the first to be paid when payment is made..."
OTHER COMPANIES HAVE EXPERIENCED SIMILAR PROBLEMS
Following that message, there was no development regarding the payment. After this stage, W. Yüzey officials and their lawyers began to investigate whether there were other companies experiencing similar problems like them. In their research, they saw that many companies were experiencing similar problems and that some companies had initiated enforcement proceedings.
PRECAUTIONARY ATTACHMENT REQUEST
After this stage, W. Yüzey İşlem applied to the Istanbul Civil Court of First Instance with a request for a precautionary attachment against TSM Construction. Meanwhile, it was understood that the A. Halat ve İş Güvenliği company had also put into effect a precautionary attachment decision it had obtained against TSM Construction through the Istanbul Anatolian 7th Enforcement Office.
TSM BECAME THE MAIN CONTRACTOR
Meanwhile, in the Akkuyu NPP project, the Russian company Titan-2 and IC İçtaş İnşaat AŞ were previously in the position of main contractor. However, the contract made with that partnership was terminated. This time, the Russian-capitalized TSM Construction, established in Mersin on October 9, 2019, took the place of the partnership. Titan-2 is also among the 3 partners of the mentioned company.
