Flash Fatih Terim claim from Seçil Erzan in court! 'He received more than his principal...'

The fraud trial of former Denizbank branch manager Seçil Erzan, who is accused of collecting money from many people in the sports and business worlds under the name of the 'Fatih Terim Fund' with the promise of high returns, continued today at the 41st High Criminal Court. 

According to the report by Osman Çaklı from Gazete Duvar; statements were taken from Seçil Erzan and the lawyers within the scope of the case, which was merged following complaints from individuals including Fatih Terim. In the proceedings, Erzan questioned why she was the only one being tried, stating that all the complaining football players knew that the money they brought was outside the banking system.

The case, which was previously held in a large hall due to the interest shown in the hearings, was held in its own courtroom at the 41st High Criminal Court for the first time. While the first hearings were watched by approximately 200 people, this hearing of the case in which Seçil Erzan is being tried was followed by approximately 20 people. Stating that she has been detained for 21 months, that her mother is ill, and that she has no one else, Erzan requested to be released. 

Highlights from Erzan's statement are as follows:

“I do not accept the allegations. Mr. President, I never had a situation where I deceived anyone. I had no intent to defraud. I did not act for any benefit, thinking that I would not be able to pay it back. The interest rates were also written on the papers I gave. I did not take a single paper from anyone for the money I earned them in excess. See that my intention was towards repayment. I was a hardworking person throughout my banking life. I earned money for people. I earned them more than their money under market conditions. None of the money was delivered to me for an official banking transaction. Everyone knew that the interest we talked about was not a banking product. The give-and-take relationship was also outside the banking system. These people took money that they could not receive on record from the bank and moved it off the record.”

Erzan continued as follows:

“I had the intention of repayment from the very beginning to the very end. I am showing the intention of repayment today as well. I want it more than anyone else. I paid interest many times over to 30 different people who are complainants, defendants, or who were mentioned but are neither complainants nor defendants. 13 of these 30 people are in this indictment. Fatih Terim and many people received more than their principal. I am not being accused for the excess money I paid to Ayhan Akman and Semih, right? There are those to whom I made partial payments. Selçuk İnan, Muslera, Burhan Taşpolat, and Pınar Güzel received partial payments. This also shows the intention of repayment. Unfortunately, there are people whose principal has not been completed and who have not received any money at all. Emre Belözoğlu did not receive any of his principal. I am telling the truth. These football players came to me by convincing each other. It is impossible for me to have taken the money of Muslera, to whom I could not even say hello. I want to fight these people, I want to wage a legal struggle. They constantly tormented me. They didn't kill me, but they made it worse than death. I can't take it anymore, I have been detained for 21 months. I have a sick mother, she has no one but me. I agree to any kind of judicial control. Please release me. 30 different people defrauded me. Why is Semih Kaya not being pursued? Emre Belözoğlu's 700 thousand dollars is with Semih Kaya.”

"IF THE HTS RECORDS ARE EXAMINED, IT WILL BE REVEALED WHO TERİM'S DRIVER RECEIVED MONEY FROM"

Seçil Erzan's lawyer also spoke in parallel with his client: “You heard Fatih Terim by instruction, we could not ask questions. For us to be able to ask them questions, the conditions must be met. Unfortunately, the indictment of this file is based on the statements of the complainants. Terim says he has a payment of 3.5 million dollars. Where was it given, how did he give it, is there a record? My client is declared to owe 3.5 million dollars based on a single message. If the HTS records are examined, it will be revealed who Terim's driver received money from. There is Arda Turan's statement; he had not deposited money for a long time and had gone to Spain. What happened that he decided to deposit money with Seçil Erzan? It means he heard from someone that it was a profitable business, so he brought his money. It can also be inferred from this that the client delivered the money. She has been detained for 21 months; detention cannot be punishment. Her mother is ill and there is no suspicion of flight.”

The lawyer for Selçuk İnan and Muslera said, “Selçuk İnan is in Antep. If his statement is to be taken, we want an instruction to be written. Muslera was at a match yesterday. In our opinion, there is no need for our clients to be heard again. Having the complainants testify again will prolong the process. There are already new witnesses at every hearing, so it should be abandoned. We were waiting for a letter from the bank, it arrived. It is unknown what the money over 500 thousand dollars was withdrawn for. The bank appears to be at fault".

The lawyer for Emre Belözoğlu and Volkan Bahçekapılı said, "We are complainants regarding the new defendants added to the file in terms of the merged file, we have a request to join".

Most of the lawyers generally shared the view that there was no need to take statements again regarding the merged file.
