Sentenced to 102 years: Reasoned decision in the Seçil Erzan case
The Istanbul 41st High Criminal Court stated that Seçil Erzan, in her capacity as a bank manager, used the trust and influence of the bank to defraud victims with the promise of a non-existent "secret fund." The reasoned decision emphasized that the relationship of trust established through forged documents constituted the crime of aggravated fraud.
The reasoning behind the conviction of former bank branch manager Seçil Erzan, who was tried on charges of defrauding numerous people—including Fatih Terim, Arda Turan, Fernando Muslera, and Emre Belözoğlu—with the promise of a high-yield "secret fund," has been released.
In the reasoned decision prepared by the Istanbul 41st High Criminal Court, it was stated that Seçil Erzan used the trust and influence provided by the bank where she worked to direct victims toward a fund that did not exist in reality, which was claimed to offer high returns and to be available only to specific individuals.
ESTABLISHED A SYSTEMATIC TRUST MECHANISM
The court noted that the defendant created a systematic relationship of trust with the victims by issuing documents bearing the bank's letterhead, fake stamps, and wet signatures. Pointing out that numerous people suffered financial losses through this method, the court emphasized that Erzan's actions were of a nature that eliminated the free will of the victims.
The reasoned decision stated that the defendant's defense arguments were not found to be in accordance with the ordinary flow of life and were therefore not credited. It was clearly stated that Seçil Erzan's actions constituted the crime of "aggravated fraud" under Article 158/1-h of the Turkish Penal Code.
The court reported that an increase in the sentence was applied, taking into account the high number of victims and the fact that the crime was committed in a chain-like manner. In this context, Seçil Erzan was sentenced to a total of 102 years and 4 months in prison and a judicial fine of 753 thousand 880 Turkish Lira.
The decision also reminded the parties that they have the right to file an appeal with the Istanbul Regional Court of Justice.
