Statement from İnan Kıraç's guardians regarding the '128 million lira fee': It was given as an advance

It had been alleged that the guardians of İnan Kıraç, who was assigned a guardian following a lawsuit filed by İpek Kıraç, had decided to pay a 128 million lira attorney fee to a lawyer from the Çorum Bar Association. A new statement has been issued regarding the fee in question.

Statement from İnan Kıraç's guardians regarding the '128 million lira fee': It was given as an advance

The lawyers appointed as guardians for Kıraç denied the allegation that an unfair attorney fee was paid by hiring a lawyer from Çorum, stating that the 128 million lira attorney fee was paid due to the value of the case, as required by law. 

In a "response and correction" statement issued by lawyers Atakan Yılmaz and Mert Öztekin, it was stated that Kıraç's previous lawyers were not dismissed, but that their power of attorney had expired, which is why an agreement was made with a different lawyer. It was noted that the case in question is the property regime lawsuit filed against İpek Kıraç in 2023 regarding the assets inherited from İnan Kıraç's wife, Suna Kıraç.

In a report published on the news site Gerçek Gündem with the byline of Seyhan Avşar, it was alleged that young lawyers were being appointed as guardians for elderly and wealthy individuals at the Anadolu Courthouse, that the appointed individuals were paying exorbitant attorney fees to lawyers in different cities, and that the two lawyers appointed as guardians for businessman İnan Kıraç had dismissed Kıraç's lawyers and paid 128 million lira to a lawyer from Çorum, Eşref Kaya, without him even attending a hearing.

Kıraç's lawyers, referring to the report, made the following statement:

“We wish to exercise our right of reply under Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed Through These Publications, as the article published on your website on 28/07/2025 at 11:15 directly involves İnan Kıraç and ourselves as his guardians. We request that the explanations below, which contain factual information based on documents, reports, and court decisions, be published within the scope of our right of reply. It will be seen when the Expert Reports and Court Decisions below are examined that the news was made contrary to documents, court decisions, and facts. It is observed that all the allegations contained in the news are intended to mislead the public, interfere with the judicial process, discredit the judges and guardians performing judicial duties, and target scientific expert reports, legal articles, ongoing proceedings, and court decisions, thereby damaging the impartiality and legitimacy of the judiciary and spreading information that threatens public peace with all these acts. In this context, it has been determined that it may constitute a crime under Articles 125, 136, 217/A, 277, and 288 of the Turkish Penal Code.

For these reasons: All expressions used in your news such as “Guardians controlling İnan Kıraç's wealth gave 128 million lira to a lawyer from Çorum” are a clear manifestation of an effort to interfere with the ongoing judicial process, target judicial authorities, and cast suspicion on public officials and physicians performing their duties.

Such distorted publications, which target the professional and personal reputation of guardians performing public duties and discredit medical findings established by the court, go far beyond the limits of freedom of the press and clearly constitute an attempt to put pressure on the judicial process.

"THEIR POWER OF ATTORNEY BECAME INVALID"

The sentence in the news content, ''Two guardians appointed a lawyer named Eşref Kaya from the Çorum Bar Association in place of the lawyers they dismissed,'' is contrary to the truth.

There is no lawyer who has been dismissed by the guardians. Due to the fact that İnan Kıraç lacks mental health and capacity to act, and because the power of attorney of Attorney Köksal Bayraktar, Attorney Mehmet İpek, Attorney Anlam Altay, and other lawyers who were also conducting the legal representation of Emine Alangoya, whose marriage was annulled, became invalid by law, it was decided to delete the UYAP records of the lawyers whose representation of İnan Kıraç had ended.

This is not a fee given or determined by us as guardians.

The fee advance (to be deducted in subsequent judicial processes) was requested by Attorney Eşref Kaya, and it was deemed appropriate by the court within the framework of the Attorneyship Law, the Turkish Code of Obligations, and other legislation for a lawyer whose contract was determined by an expert report and permitted by the court to receive a 4% fee advance of 128,000,000 TL in a case with a case value of 3,198,469,751.52 TL, and it was ordered to be given to the relevant lawyer Eşref Kaya.

There are more than 30 civil lawsuits in which Mr. İnan Kıraç is a party and numerous criminal investigations in which he is involved as a complainant. These are cases that were filed and are ongoing before the restriction decision was issued.

Specifically, in the property regime lawsuit (participation receivable) filed against İpek Kıraç in 2023 regarding the assets inherited from the late Suna Kıraç on behalf of İnan Kıraç, the Istanbul Anadolu 6th Family Court decided to have a fee of 54,621,867.19 TL completed based on the case value. In line with this decision, the case value continues for now as 3,198,469,751.52 TL.

An expert examination was conducted by the guardianship authority regarding the attorney agreement to be signed at the lowest limit based on the fee schedule in accordance with Article 164 of the Attorneyship Law with Attorney Eşref Kaya, who has approximately 30 years of legal experience and represents İnan Kıraç. Indeed, the attorney agreement, which was determined to be in the interest of the restricted person and made based on the lowest tariff as required by law, was signed with the expert report and the permission of the guardianship authority.

Attached is the expert report determining that the attorney agreement is in the interest of the restricted person and the court's permission decision.

The lawyer requested an advance to be deducted from the fee he is entitled to under the Attorneyship Law for the cases and investigations he is handling, and the court decided that the relevant advance should be given to him based on the case value.

A 4% fee advance of 128,000,000 TL in a case with a case value of 3,198,469,751.52 TL for a lawyer whose contract was determined by an expert report and permitted by the court was deemed appropriate by the court within the framework of the Attorneyship Law, the Turkish Code of Obligations, and other legislation.

Directly targeting the guardians in the news is not only contrary to the truth but also constitutes misleading news. We will exercise all our legal and criminal rights.

It is an advance payment given to İnan Kıraç's lawyer Eşref Kaya with an expert examination and court decision determined in line with the law and tariffs. The fee advance payment in question has nothing to do with the guardians or guardianship.
