Prof. Dr. İzzet Özgenç, a criminal law expert and former legal advisor to AKP Chairman and President Recep Tayyip Erdoğan, has made a statement evaluating the impact of the framework law—which was adopted as is by the TBMM Justice Commission—on the detention status of former HDP Co-Chair Selahattin Demirtaş, who is currently in prison.
Legal experts are providing evaluations regarding the Draft Law on Strengthening National Solidarity and Social Integration, which is currently being discussed in the TBMM Justice Commission.
Prof. Dr. İzzet Özgenç, a criminal law professor and former chief advisor to AKP Chairman and President Recep Tayyip Erdoğan, evaluated the potential legal consequences of the regulation for former HDP Co-Chair Selahattin Demirtaş in a post on his social media account.
In his post, Özgenç stated the following:
"According to the information I have obtained, Selahattin Demirtaş has been convicted of the crime of attempting to undermine the unity of the State and the integrity of the country (Turkish Penal Code, Art. 302).
Whether this conviction verdict aligns with material reality can only be evaluated upon examination of the relevant case file.
According to Draft Law No. 2/3793, which was adopted as is by the TBMM Justice Commission, Selahattin Demirtaş will be released if he makes a request (!)."
