Strange HGS incident on Istanbul-Edirne bus

A teacher's refund request was found to be justified after a highway toll was deducted from the HGS tag kept in their bag during a bus trip from Istanbul to Edirne.

Teacher A.D., who lives in Edirne, traveled from Istanbul to Edirne on April 19, 2023, on a bus they boarded on the Anatolian side, sitting by the window.

Upon checking their credit card statement, A.D. noticed that 136 lira and 50 kuruş had been deducted from their HGS account as a Northern Marmara Motorway toll on the date corresponding to the Istanbul-Edirne trip.

A.D. went to the Edirne Provincial Directorate of Trade and applied to the Consumer Arbitration Committee, claiming that the toll was charged from the HGS tag in their bag despite them being a passenger on the bus.

The committee, which reviewed the application, examined the bus ticket and found the consumer to be in the right, noting that they were traveling by bus on the specified date and had not passed through with a vehicle, yet the fee was collected from their HGS sticker.

The decision was notified to the operator of the Northern Marmara Motorway. The matter was taken to court after the company, to which the decision was notified, filed an objection with the Edirne 2nd Civil Court of First Instance.

Since there is no Consumer Court in the city, the hearing was held at the Edirne 2nd Civil Court of First Instance.

During the hearing, A.D. stated that the fee was deducted from them even though they did not pass through with their vehicle and requested that the company's lawsuit be dismissed. The company lawyer requested that the lawsuit be accepted.

The judge decided to reject the company's lawsuit request.

Accordingly, the fee deducted from A.D.'s HGS tag will be refunded.
