Striking details in the 199-page police report submitted to the court! Did Ayhan Bora Kaplan have the furniture in Supreme Court member Yüksel Kocaman’s villa made?

New details continue to emerge regarding the Ayhan Bora Kaplan Criminal Organization investigation, which has dominated Turkey's agenda and caused an earthquake within the Ankara Police Department.

T24 columnist Tolga Şardan reported on the instruction letter sent by Public Prosecutor Mustafa Kaya to the Ankara Police Department's Organized Crime Bureau, following information provided by the secret witness codenamed M7, Serdar Sertçelik, regarding the investigation in question.

The instruction letter sent by Kaya with the note 'urgent/important' included the following 3 points:

“The secret witness memorandum is attached to our letter to serve as a basis for the evidence collection process in this investigation file currently being conducted by our Chief Public Prosecutor's Office.

Accordingly;

The secret witness's statement must be meticulously examined to determine which events in the indictment it covers, and necessary research must be conducted regarding allegations not involved in the events,

Additional instructions must be obtained from the investigation prosecutor regarding the new evidence that emerges,

It is requested that the prepared documents be sent to our Chief Public Prosecutor's Office urgently without leaving any room for reminders.”

Following Kaya's instruction, the Ankara Police Department Organized Crime Bureau (OSM) prepared a 199-page research report as a result of 4.5 months of investigation.

In his column on T24, Şardan included striking information contained in the research report in question.

One of the most notable details in the 199-page report, prepared based on the statements of secret witness Serdar Sertçelik, is the allegation that Yüksel Kocaman, the former Ankara Chief Public Prosecutor and current Supreme Court member, who claimed to have met with Ayhan Bora Kaplan only once, had furniture made for his luxury villa in Gölbaşı and that the cost was paid by Kaplan.

The following statements were included in the prepared report;

“(…) As can be understood from the statements obtained from those with knowledge; while organization leader Bora Kaplan was sitting in Cengiz Haliç's office, he called Emre Cihan Akalın and a person named Garip Ümit, whom they knew as Şinasi, to the office, and Bora Kaplan gave instructions that the furniture for Yüksel Kocaman's house would be made, that Emre Cihan Akalın would handle the design, and that the person named Garip Ümit would make the furniture,

It is understood from the statements obtained that Emre Cihan Akalın and the person named Garip Ümit went to the Hera Wedding Halls side in Gölbaşı, which is the address of Yüksel Kocaman's house, and upon failing to reach an agreement on the price with the person named Garip Ümit, the furniture in question was made by a person named Mustafa Hallik, and that a person named Ahmet Ali Gebeş, who worked for Mustafa Hallik, went to assemble this furniture, and that Emre Cihan Akalın and the person named Garip Ümit even went to Yüksel Kocaman's office to show fabric samples. (…)”

BMW ALLEGATION

On the other hand, the report also included allegations regarding Yüksel Kocaman's renewal of his personal vehicle.

The relevant part of Tolga Şardan's article is as follows;

"The Ankara Police OSM Bureau also investigated allegations regarding Ankara Chief Public Prosecutor Yüksel Kocaman's renewal of his personal vehicle. It was alleged that Kocaman renewed his vehicle through Ayhan Bora Kaplan, and an access ban had been imposed on news reports regarding this matter.

During this process, it is alleged that Chief Prosecutor Kocaman carried out all transactions regarding his vehicle through his bodyguard, Mevlüt Özdemir.

The report includes the exchange of money between some names mentioned in the Ayhan Bora Kaplan criminal organization investigation and Arslan.

No direct determination is made, but Arslan's connections with both sides are implicitly pointed out. It is understood that Kocaman's bodyguard purchased two luxury vehicles from Arslan's firm, sold the old vehicles there, and traded the vehicles.

The statement given to the police by Murat Arslan, the owner of the automotive firm named MAS Group, which handled Kocaman's vehicle purchase and sale transactions, and which is also included in the report, is as follows:

“(…) I know the person named Ayhan Bora Kaplan because I saw him with people named Doğan Kaan Yıldız and Ozan Can Yıldız about ten years ago. I heard that this person had an entertainment venue called Albüm. However, I have no direct contact with this person. I have never been side-by-side with this person and have never dealt with him. However, I attended his son's circumcision wedding because an invitation arrived for it.

The person I actually know is Tansel Aktan. I also got to know Tansel Aktan because I saw him with Doğan Kaan Yıldız. However, the reason for our closeness is that this person used to do auto detailing in Şaşmaz and had a shop called Tam Cars. I became close with him because he did all the work on my cars, and later I became the godfather to his child.

I know the person named Serdar Sertçelik because he was a partner with Elmacı Markets alongside Doğan Kaan Yıldız. I never sold a vehicle to this person.

Regarding the statements read to me; I did not know the person named Yüksel Kocaman. However, regarding vehicle trading, in 2020, I bought a 2020 model white or gray BMW 5.20 brand vehicle with the license plate 80 HA 552 in Osmaniye province and brought it to my workplace. I put it up for sale in an advertisement. I received a trade-in offer for this vehicle from the advertisement. I did not know who the person making the trade-in offer was. After this conversation, two people whom I knew as bodyguards came to the shop and said they had a BMW 3.20 brand vehicle and wanted to trade it. I said it could be possible if we looked at the vehicles mutually and agreed on the price. On the same day or the day after this conversation, two bodyguards came to my shop in an official vehicle. However, I did not know whose bodyguards these people were.

On a day whose exact date I do not remember; after the two bodyguards brought the 2019 model white and gray BMW 3.20 brand vehicle with license plate 06 BPC 009 to my shop, we started bargaining with the bodyguards, and we agreed that I would receive 150 thousand TL on top of my BMW 5.20 brand vehicle in exchange for the BMW 3.20. The people whose names I do not know, but whom I remember as Mevlüt Özdemir and Hakan, who I saw from the sales documents also held Yüksel Kocaman's power of attorney, came to the shop with 150 thousand TL in a black bag in their hands and carried out the sale of the vehicles in question. The person who bought the vehicle on behalf of Yüksel Kocaman is the person named Mevlüt Özdemir. I learned that these people were prosecutor bodyguards after this vehicle was sold. Before this sale, I did not know whose bodyguards these people were.

Our trade with the person named Yüksel Kocaman took place in this way. The license plate of the BMW 5.20 brand vehicle I sold was also changed to 06 BVG 911 after it was sold. About seven months after I sold the vehicle, the person named Mevlüt Özdemir, who was Yüksel Kocaman's bodyguard, called our shop again and asked if he could trade the 2020 model Land Rover brand vehicle with license plate 34 DGS 116, which he saw in the advertisement, with the BMW 5.20 brand vehicle he had bought from us seven months ago.

Upon our acceptance of this offer, a person who was with him, whom I knew to be Yüksel Kocaman's bodyguard because I had sold him a vehicle before, came to my shop. They examined the Land Rover brand vehicle in the advertisement. The price of the Land Rover brand vehicle at that time was 1 million 100 thousand TL. The person named Mevlüt Özdemir started bargaining, and we reached an agreement that we would trade the BMW 5.20 brand vehicle for this vehicle and receive 210 thousand TL on top of it. And on 11.11.2020, at the 37th Notary Public located in the Emek district of Ankara, the person named Mevlüt Özdemir bought this vehicle with a power of attorney on behalf of Ayça Kocaman, and the 210 thousand TL difference was transferred from Kocaman's bank account to the account of the company named MAS Motor, which I own. I know that the license plate of the vehicle in question was changed to 06 AEK 111 after it was sold, and the sale of this vehicle was also carried out by the person named Burak Furkan Aksu, who works in my shop. (...)”

MASAK DATA IN THE REPORT

In addition to the statements and information in question, the police research report included money transfer records belonging to Murat Arslan.

The report stated:

“In the examination of the data on the page for the banking transfer sent by MASAK, the money transfers received by the person named Murat Arslan from other persons and companies within the scope of the investigation are shown below:

It was determined that he received a total of 500,000 TL in 4 transactions from the person named Doğan Kaan Yıldız,

He received 14,000 TL in 3 transactions from the person named Nihal Akbaba,

He received 10,000 TL in two transactions from the person named Salim Turan,

He received a total of 766,500 TL in 13 transactions from the person named Tansel Aktan,

He received a total of 436,900 TL in six transactions from the company named Yıldızlar Saç İnşaat,

He received a total of 50,000 TL in two transactions from the company named EA Motorlu Araçlar.”
