TBB requests investigation into members of the Court of Cassation and the 13th High Criminal Court
The Union of Turkish Bar Associations (TBB) has filed an application requesting the initiation of a criminal investigation into the panel of the Istanbul 13th High Criminal Court and the members of the 3rd Criminal Chamber of the Court of Cassation for failing to implement the rights violation ruling issued regarding imprisoned TİP Hatay MP Şerafettin Can Atalay.
The Union of Turkish Bar Associations (TBB) has filed an application requesting the initiation of a criminal investigation into the panel of the Istanbul 13th High Criminal Court and the members of the 3rd Criminal Chamber of the Court of Cassation for failing to implement the rights violation ruling issued regarding imprisoned Workers' Party of Turkey MP Şerafettin Can Atalay.
In a statement released by the TBB, it was stated: "Following the second rights violation ruling issued regarding the individual application of Hatay MP Şerafettin Can Atalay, an application was made to the Ministry of Justice General Directorate of Criminal Affairs on 29.12.2023, immediately after the decision was rendered, requesting the initiation of a criminal investigation into the Istanbul 13th High Criminal Court panel that failed to implement the ruling, for violations of Articles 109 (Deprivation of liberty), 257 (Abuse of office), and 309 (Violation of the Constitution) of the Turkish Penal Code."
The statement further added: "Furthermore, following the second decision issued by the 3rd Criminal Chamber of the Court of Cassation regarding the individual application of Şerafettin Can Atalay, an application was submitted to the First President of the Court of Cassation, to be presented to the First Presidency Board of the Court of Cassation, requesting the initiation of a criminal investigation into the President and members of the 3rd Criminal Chamber of the Court of Cassation for violations of Articles 109 (Deprivation of liberty), 257 (Abuse of office), 301 (Insulting the Turkish Nation, the State of the Republic of Turkey, and the institutions and organs of the State), and 309 (Violation of the Constitution) of the Turkish Penal Code, and requesting that the investigation be conducted effectively and efficiently to ensure that a public lawsuit is filed against them for their punishment."
