They did not recognize the Constitutional Court: Date scandal in the local court's Can Atalay ruling!

The Constitutional Court (AYM) had ruled that a 'violation of rights' occurred in the case of TİP Hatay MP Can Atalay, who is being tried in the 'Gezi Park Case', and had requested his release. The Istanbul 13th High Criminal Court sent Atalay's file back to the Court of Cassation. 

Journalist Alican Uludağ shared the date scandal in the text of the ruling issued by the Istanbul 13th High Criminal Court on his social media account.

Drawing attention to the contradiction between the dates, Uludağ stated: "The Can Atalay ruling was not issued by the panel, but by the presiding judge alone. Moreover, the date of the ruling was written as October 13. The AYM's violation ruling was on October 25."

SUSPICION OF 'PRE-PREPARATION' IN THE RULING

The Constitutional Court was set to deliberate on the individual application made by Can Atalay on October 12. However, the Constitutional Court had postponed the application of Can Atalay to October 25 after a member stated that they were not prepared for the file during the meeting. The fact that the date October 13 was written in the ruling issued by the 13th High Criminal Court today (October 30, 2023) led to suspicions that the court had anticipated the AYM ruling and prepared its decision on that date.
