A verdict has been reached in the trial of Dilan and Engin Polat, the couple who were recently released from prison and accused of assaulting their neighbors.

On June 2, 2023, in Çekmeköy, Istanbul, Engin Polat and Dilan Polat got into an argument with their neighbor Metin Atayeter over a parking space. After the argument quickly escalated into a fight, Metin Atayeter, who was assaulted, filed a criminal complaint against the Polat couple.

According to a report by Fahrettin Öztürk from Cumhuriyet; following the complaint, a lawsuit was filed seeking up to 8 years and 4 months in prison for Dilan Polat on charges of 'insult', 'assault', and 'threat with more than one person', and up to 11 years and 4 months for Engin Polat on those same three charges plus 'violation of residential immunity'.

The Polat couple and Metin Atayeter did not attend the hearing held at the Anatolian 35th Criminal Court of First Instance.

The lawyers presented their final defenses against the opinion on the merits announced at the previous session.

'THE PROSECUTOR DID NOT TAKE OUR WITNESSES' STATEMENTS INTO ACCOUNT'

Stating that he had submitted his defense in writing to the file, the Polat couple's lawyer said, "We do not accept the opinion that a new report should be filed against Dilan Polat. There is no evidence that Dilan Polat committed the crime of 'violation of residential immunity'. During the investigation phase, a decision of non-prosecution was issued regarding Dilan Polat and the other suspects. The prosecutor considered the crime proven by looking only at the statements of the complainants without taking into account what our witnesses said. The principle that the defendant benefits from doubt has been completely violated."

The lawyers for the victim, Metin Atayeter, stated that they had nothing to say against the opinion, adding, "The parties have reached a settlement. We request that the case be dismissed."

CASE DISMISSED FOR 3 CHARGES

Announcing its verdict, the court decided to dismiss the case regarding the charges of 'insult', 'assault', and 'threat' against Dilan Polat and Engin Polat, as the victim Metin Atayeter withdrew his complaint.

ENGIN POLAT'S PRISON SENTENCE SUSPENDED

The court also acquitted Dilan Polat of the 'threat' charge on the grounds that the crime was not proven. Engin Polat was sentenced to 1 year, 11 months, and 10 days in prison for the crime of 'violation of residential immunity by more than one person at night'.

The court ruled that Engin Polat's sentence be suspended.
