Third release petition filed for Ramazan Gülten: 'It is contrary to the natural flow of life'

The application for Ramazan Gülten's release stated, "It is both a humanitarian and medical necessity for the client to be with his wife during this process; as the pregnancy is high-risk and there is a possibility of premature birth."

According to a report by İsmail Arı from BirGün, a third request for release has been filed for Istanbul Metropolitan Municipality Head of Zoning and Urban Planning Department Ramazan Gülten.

In the petition submitted by Ramazan Gülten’s lawyers, Hüseyin Ersöz and Enes Ermaner, to the Istanbul Chief Public Prosecutor's Office to be presented to the Istanbul (Duty) Criminal Court of Peace, the following statements were included:

“It is understood that our client, Ramazan Gülten, is a public official who has served in the public sector for many years, has never been subject to any judicial or administrative investigation to date, has no criminal record, and holds a respected position in society; and that for the first time within the scope of this investigation, he has been accused of crimes based on some entirely unsubstantiated, subjective, and abstract statements, and expert reports in which his name is not even mentioned.”

The petition, which also emphasizes that Gülten’s wife is about to give birth, included the following statements:

“Our client has been detained for nearly 3 months, and his wife is currently in the 38th-39th week of pregnancy, in other words, almost nine months, and there are only days left until the birth. Furthermore, all evidence in the file regarding our client is indirect, based on assumptions, and of a fictional nature. With our defenses, all of this evidence has been refuted one by one, and no direct, material evidence regarding the alleged crime has been presented.

When the client's situation is examined in terms of the suspicion of flight, the assumption that he would flee leaving his family behind while his wife is days away from giving birth is clearly contrary to the natural flow of life. On the contrary, it is both a humanitarian and medical necessity for the client to be with his wife during this process; as the pregnancy is high-risk and there is a possibility of premature birth.

Preventing a father from seeing his child come into the world by depriving him of his freedom due to an allegation based entirely on assumptions and indirect evidence is a very serious interference with family life and is of a nature that will lead to damages that are difficult, if not impossible, to compensate.”
