Tolga Şardan analyzes: The complaint letter Uçar wrote to the HSK is setting the agenda

Istanbul Anatolian Chief Public Prosecutor İsmail Uçar, who has remained on the agenda with his complaint letter to the HSK, was among the prosecutors who conducted the 'parallel structure' investigations within the Police Department.

Following the March 31 elections, some investigations regarding allegations of irregularities in Istanbul were also opened under Uçar's instructions.

Some opposition figures evaluated Uçar's letter to the HSK as a 'factional war within the government and judicial circles.'

Journalist Tolga Şardan, in his column where he set out from Uçar's letter and the names mentioned therein, conveyed the latest developments he obtained from judicial sources.

Here are the highlights from Şardan's article:

A proposal for "dismissal from the profession" was made against Judge Sidar Demiroğlu in two separate files. Sources stated that while there was no finding regarding the "bribery" allegation in the dismissal proposal against Demiroğlu, there was a justification for bringing the profession into disrepute.

The scandals of a judge named Gül A., who served at the Adana Courthouse and whose story began in Edirne and extended to Adana, were among the most striking headlines of last week.

During the administrative investigation conducted by the Council of Judges and Prosecutors (HSK), the findings regarding the judge's private life and professional career are jaw-dropping.

While I do not want to repeat them here, the events and developments that have surfaced in the judicial system have unfortunately evolved into a state that requires intervention by those in the decision-making and implementation mechanism.

This environment did not form overnight, undoubtedly.

As you may recall, Istanbul Anatolian Chief Public Prosecutor İsmail Uçar had sent a special letter to the HSK regarding corruption and irregularities in the judiciary.

Among the members of the judiciary against whom Uçar filed a complaint is Judge Sidar Demiroğlu, who serves at the Anatolian Courthouse.

He emphasized that information was received that decisions were made in exchange for money regarding the blocking of access by criminal judgeships of peace at the courthouse and that unlawful releases were carried out.

Chief Prosecutor Uçar explained that during his evaluations with commission member Nihat Zincirli regarding the developments, he made findings about Demiroğlu, who served as the 4th Criminal Judge of Peace, in line with the information coming from Zincirli's wife, who is also the director of the 4th Criminal Judgeship of Peace.

He included the allegation that Demiroğlu examined files on days when he was not on duty and pressured clerks to have certain files sent to his own court.

Uçar even shared the information that although Zincirli conveyed the information from his wife to the previous President of the Anatolian Courthouse Justice Commission, the President did not care about the situation, yet Demiroğlu was intended to be made the President of the High Criminal Court.

So, what did the HSK do after the letter arrived?

An inspector investigation was launched regarding the allegations. The inspectors collected information and documents.

According to the information I obtained from judicial sources; HSK inspectors have completed the section regarding Judge Sidar Demiroğlu.

In the inspector report prepared about him, a proposal for "dismissal from the profession" was made against Demiroğlu in two separate files.

Sources stated that while there was no finding regarding the "bribery" allegation in the dismissal proposal against Demiroğlu, there was a justification for bringing the profession into disrepute.

Of course, the process will not end with the inspector report prepared about Demiroğlu. The inspector report will be discussed in the Second Chamber of the HSK. This meeting will most likely take place after the judicial recess.

Afterwards; the opinion to be given by the Second Chamber will be discussed and decided upon in the general assembly chaired by the Minister of Justice. There is no restrictive calendar for this process.

Let me give an example of the calendar; the file of Adana Courthouse Judge Gül A., which came to the agenda last week, dates back to 2022. Why did the file, which has been waiting for two years, wait for two years due to "which balances"? Or was the dismissal decision put into practice last week?

Therefore, it may take months or even years for Demiroğlu's file to be prepared and decided upon. Depending on the balance in politics and bureaucracy!

REGARDING HSK APPOINTMENTS

The HSK published its summer decree last week. Nearly 4,500 judges and prosecutors in judicial and administrative judiciary across the country changed positions within the framework of the decree.

With the publication of the decree, prosecutors who signed important files and judges who presided over trials became news.

However, there are undoubtedly striking appointments in the same decree, even if they seem simple.

I think it is more meaningful to reveal the addresses of the appointments rather than going through names.

For example; in the appointments for the Istanbul Çağlayan Courthouse, 98 judges and prosecutors changed places with each other.

Another example is that a total of 118 judges and prosecutors changed places, including those coming and going, at the Istanbul Anatolian Courthouse, which was the subject of former Chief Prosecutor Uçar's letter.

It is seen in the decree that 31 judges and 24 prosecutors changed places at the Bakırköy Courthouse, which is at the center of criticism allegations.

Again, a total of 22 judges and prosecutors at the Istanbul Gaziosmanpaşa Courthouse, 39 members of the judiciary, including 12 judges and 27 prosecutors at the Küçükçekmece Courthouse, and 17 prosecutors at the Büyükçekmece Courthouse were subject to appointment.

The situation in Ankara is similar to Istanbul. A total of 84 appointments were made for the Ankara Courthouse, including 36 judges and 48 prosecutors. It is possible to see that a total of 20 judges and prosecutors are in the decree at the Sincan Courthouse, known as the Western Courthouse.

By the way, let's look at the famous tourist resorts that are a bit by the water.

Within the framework of arrivals and departures, the HSK included 45 judges and prosecutors at the Bodrum Courthouse, 54 at the Fethiye Courthouse, and 17 at the Marmaris Courthouse in the decree. On the other hand, the number of judges and prosecutors who came to the Muğla Courthouse and left the city was only 8!

18 members of the judiciary changed at İzmir's Çeşme Courthouse, and the appointment process of 18 judges and prosecutors at Aydın's Kuşadası Courthouse was included in the decree. A total of 66 judges and prosecutors at the courthouse in Antalya's Alanya district and a total of 70 judges and prosecutors at the Mersin Courthouse were included in the decree.

VEYSEL KAÇMAZ REMAINED OUTSIDE THE DECREE

Meanwhile, it was noteworthy that Deputy Chief Public Prosecutor Veysel Kaçmaz, who was considered certain to be appointed, remained outside the decree.

TİP MP Ahmet Şık mentioned the trouble experienced between Kaçmaz and Chief Public Prosecutor Gökhan Karaköse in his speech at the Turkish Grand National Assembly in recent days.

Despite the trouble alleged to have occurred between the Chief Prosecutor and his deputy, Kaçmaz's success in remaining in his position is among the topics discussed in judicial corridors.
