Tolga Şardan's computer and phone seized

T24 columnist and journalist Tolga Şardan, who was arrested on the grounds of a column claiming that "the Presidency has ordered an investigation into allegations regarding the judiciary," had his home searched. Following the search, Şardan's mobile phone and computer were seized with the stated intent of examination.

SEIZED WITHOUT BACKUP

According to the Criminal Procedure Code (CMK), before a seizure operation is carried out, the computer and mobile phone must be backed up, and a copy of the backup must be provided to the suspect or their lawyer.

However, it was understood that during the search at Şardan's home, the computer and mobile phone were not backed up, and the seizure was carried out without performing this backup process.

This regulation in the CMK is intended to prevent the subsequent addition of data to seized digital materials such as computers and phones. In many previous investigations, the police have been criticized for seizing digital materials without performing this procedure.

In numerous cases, allegations have been raised that digital data had been tampered with.
