The court has issued a stay of execution in the relevant case. Türk Eğitim Sen shared the decision with the note, "The judiciary has put a stop to the interview fiasco."

"THE JUDICIARY HAS PUT A STOP TO THE INTERVIEW FIASCO"

In its post regarding the decision, Türk Eğitim Sen used the phrase, "The judiciary has put a stop to the interview fiasco." The statement regarding the decision read as follows:

"As is known, in the oral exams conducted by the Ministry of National Education for the employment of 20 thousand contract teachers based on 2023 KPSS scores, different practices were carried out by exam commissions in different provinces; in some provinces, scores were rounded to provide standard scores, while in others, high scores were added to the KPSS score to determine oral exam scores. This difference in practice caused some candidates who were within the quota based on their KPSS scores to fall outside the quota and fail to be appointed based on their oral exam success scores.

As Türk Eğitim Sen, our union has provided legal support to candidates who were aggrieved by the oral exam results during this process. In the lawsuit filed by our union's lawyers, the Ankara 19th Administrative Court, with its decision dated 05.02.2025 and numbered 2024/1772 E., has granted a stay of execution for the process regarding the rejection of the plaintiff's objection to the oral exam score."

RATIONALE FOR THE DECISION EXPLAINED

The rationale for the Ankara 19th Administrative Court's decision included the following statements:

"In this context, it is observed that the plaintiff was given a '0' score by all exam commission members in terms of the 'educational sciences' criterion, while being given a full score of '5' under the sub-headings of 'ability to grasp and summarize a subject, expression ability, and reasoning power' regarding the teaching process. Accordingly, there is no explanation in the evaluation form as to why the plaintiff was given a '0' for the educational sciences criterion, nor could the awarding of full scores for similar criteria be justified with a concrete reason. Furthermore, it is seen that there are no answers to questions 2025 and 3034 asked to the plaintiff.

In this case, since no concrete justification was provided for giving a '0' score for the 'educational sciences' criterion, and since it is contrary to the ordinary flow of life for all commission members to award the same score for all criteria and sub-criteria despite evaluating them separately, it is concluded that the discretionary power was not used objectively. Therefore, it is concluded that there is no compliance with the law in the process of rejecting the plaintiff's objection to being deemed unsuccessful as a result of the oral exam.

On the other hand, considering that if the process subject to the lawsuit continues, other candidates who were successful in the oral exam may be appointed, and the plaintiff's right to work may be harmed in the event of a possible lack of positions, it is clear that irreparable damages may arise if the process continues to be applied until the lawsuit is concluded."
