Turkey's objection regarding Demirtaş rejected: 'Legally problematic'
The second section of the European Court of Human Rights (ECHR) found the re-arrest of former HDP Co-Chair Selahattin Demirtaş in the context of the Kobani Case to be "legally problematic" and ruled that his rights had been violated.
The ECHR also found the evidence presented for the decision to be insufficient, concluding that domestic legal authorities ignored alternatives to detention for the purpose of "obstructing the applicant's political activities."
Furthermore, it deemed the length of the decision-making process regarding the three individual applications Demirtaş made to the Constitutional Court (AYM) as a violation.
EXPECTATION OF RELEASE
Turkey objected to the violation ruling issued regarding Demirtaş and sought to refer the decision to the Grand Chamber. The ECHR rejected the objection.
The ECHR rejected the request to refer the 'Demirhan and Others v. Turkey' and 'Selahattin Demirtaş v. Turkey (no. 4)' decisions to the Grand Chamber, and the rulings have become final.
The applicants in the 'Demirhan and Others' case will be able to request a retrial from the courts that issued their convictions within 1 year.
The ECHR ordered Turkey to pay 55 thousand 745 Euros in compensation, including court costs.
Legal experts shared that the release of Selahattin Demirtaş, Figen Yüksekdağ, and other politicians in the Kobani Case is expected.
