Court of Cassation President Akarca: We have deep disagreements with the Constitutional Court

Court of Cassation President Mehmet Akarca made a statement regarding the second ruling of rights violation issued by the Constitutional Court concerning Can Atalay, who was elected as a deputy from the Workers' Party of Turkey (TİP).

During his visit to the Afyonkarahisar Governor's Office, President Akarca stated that there have been long-standing differences in the interpretation of the individual application process and the Constitution, noting, "It is a fact that we have serious and deep disagreements stemming from the differences in interpretation regarding the examination of the individual application process, which has been ongoing for about 5-6 years, and the state of the Constitution."

WHAT HAPPENED?

The 3rd Criminal Chamber of the Court of Cassation evaluated the Constitutional Court's ruling on Can Atalay and decided that the AYM's rights violation ruling had no legal value. The Chamber also decided not to comply with the AYM's second rights violation ruling. This decision was widely debated in political circles.
