Went in for a nose job, lost her legs: Victim faces threat of enforcement proceedings!

Sevinç Çelik, who underwent a rhinoplasty operation at Medipol Hospital in 2014, lost her legs due to an infection that entered her bloodstream during the surgery.

Çelik, who also lost the legal battle she had been waging for 10 years, had the litigation process evaluated by her lawyer Hayriye Çağır for 12punto.com.tr.

THE CASE LASTED 10 YEARS

Regarding the case that lasted 10 years, Çağır stated the following:

"We filed a lawsuit for pecuniary and non-pecuniary damages against the hospital regarding the process that led to the amputation of our client Sevinç Çelik's legs after she fell ill immediately following a nose operation for aesthetic purposes at the hospital; the case lasted approximately ten years. It was claimed in the reports that there was no fault in the aesthetic surgery."

THE CASE WAS DISMISSED

Stating that her client had no prior illnesses, Çağır noted the following regarding the trial process:

"The fact that she fell ill after the operation and was brushed off without any examination, despite reporting these complaints to the relevant doctor and hospital, was never evaluated during the trial.

In our opinion, the hospital's and the doctor's aggravated duty of care was not properly evaluated during the trial. The client's complaints were dismissed as 'complications' and she was not examined; furthermore, the case was dismissed on the grounds that she had a pre-existing illness, which she never had before."

"WE APPLIED TO THE REGIONAL APPELLATE COURT"

Pointing out that she had no illnesses before the aesthetic surgery, Lawyer Çağır continued her words as follows:

"Witnesses were heard during the trial. The witnesses also stated that Sevinç Çelik did not have any illness and that she fell ill and became incapacitated after the surgery. Although the court dismissed the case, we applied to the regional appellate court, which is the higher court, against this decision."

FACING THE THREAT OF ENFORCEMENT

Stating that her client has both lost her two legs and is being victimized by an enforcement order, Çağır said, "The file is still waiting for its time to be reviewed, while the hospital has initiated enforcement proceedings against the client for the attorney's fee ruled in favor of the hospital due to the dismissal of the case, and currently, the client has both lost her two legs and is under the threat of enforcement," she said.
