Bad news for vacationers! Fines of up to 1 million liras coming for daily home rentals

With the start of the 2nd legislative year of the 28th term of the Grand National Assembly of Turkey (TBMM) on Monday, October 1, the details of the new legal regulation expected to come into force for daily rental homes have begun to take shape. Real estate expert Şule Duman, who provided information about the details of the regulation, said that a licensing requirement would be imposed on those who provide rental services. Stating that those who do not obtain a 'tourism residence' license from the Ministry of Culture and Tourism and rent out their homes without complying with legal obligations will face a fine of approximately 1 million liras, Duman noted that those who rent unlicensed homes will also be subject to fines.

LICENSE AND PERMISSION REQUIREMENT

Discussing the details of the new regulation, which is expected to be approved by the TBMM and published in the Official Gazette in the coming period, Duman said that those providing daily home rental services will also need to make many arrangements. Stating that valid documents must first be obtained from the Ministry of Culture and Tourism, Duman said, “A legal regulation by the TBMM was expected for the daily home rental service, which has increased significantly in recent years. As a result of the legislative year work that began in recent days, the details of the new regulation prepared for daily rental homes have become clear. According to the regulation, those providing daily home rental services will first need to obtain a 'Tourism Residence' license from the Ministry of Culture and Tourism and will be required to hang it outside the residence. Those who do not fulfill this obligation will not only be unable to rent out their homes, but this will not be their only responsibility. For example, those who want to provide daily home rental services will now even have to get permission from their neighbors. While the details of the regulation state that service providers are required to obtain written consent from each neighbor, if even one person from the apartment residents objects, the rental transaction will not be carried out. Those who do not comply with the legal requirements will face a fine of nearly 1 million liras,” she said.

IDENTITY INFORMATION WILL BE RECORDED

Stating that citizens renting daily homes will receive service under better conditions with the new regulation, Şule Duman said that those who rent unlicensed homes could also be fined. Providing information about the legal obligations for those providing rental services, Duman said, “It seems that the things that need to be done by those who want to obtain a license will not end with obtaining consent from their neighbors. First of all, there will be features that must be present in homes to be rented out daily. According to the details of the regulation, for example, a fire escape, a fire report certificate, and a waste control certificate will be mandatory in the homes in question. In addition, items such as hair dryers, shampoo, bed linen, and towels, which are mandatory in hotels, will also be required to be present in the home. I can say that these homes will be in the comfort of a hotel in a way. In addition to these, identity information will need to be recorded in these homes, just as it is mandatory in hotels. It is anticipated that the e-Devlet application will be used so that the information to be taken for security records can be processed easily and quickly. Of course, homeowners who do not share information here will also face fines,” she said.
