Council of State rules against TurkStat: DISK found to be in the right

A verdict has been reached in the lawsuit filed by DISK against the Turkish Statistical Institute (TurkStat) for failing to publish the item basket. The court rejected TurkStat's appeal.

Council of State rules against TurkStat: DISK found to be in the right

Following the Turkish Statistical Institute's (TurkStat) decision to stop publishing the item basket as of June 2022, a verdict has been reached in the lawsuit filed by DISK against TurkStat.

In a statement released by DISK, it was noted that the lawsuit filed against TurkStat had been won.

"IT IS OBLIGATED TO COMPLY WITH THE RULING"

The statement included the following remarks: “We won the lawsuit we filed against TurkStat after it stopped publishing the item price list used for inflation calculations in June 2022, and the decision, which was appealed by the ministry and TurkStat, has become final. As per the judicial decision upheld by the appellate court, TurkStat is obligated to publish the item price list again. The TurkStat Presidency is not a place to violate judicial decisions. Pursuant to Article 138 of the Constitution, court rulings are binding on everyone, including the TurkStat Presidency.”

Noting that they submitted a request to TurkStat on April 2, 2024, to implement the administrative court's decision following the finalization of the judicial ruling, DISK stated, "All avenues attempted by the TurkStat Presidency have been exhausted. The judicial decision is final. Article 138 of the Constitution is extremely clear: The legislative and executive organs, as well as the administration, are obligated to comply with court rulings; these organs and the administration cannot change court rulings in any way, nor can they delay their execution."
