Retirees are unaware of their rights! Is double salary and promotion possible?

SGK Chief Specialist İsa Karakaş explained the little-known rights of working retirees.

"We need to discuss all the rights of retirees from A to Z. Because, unfortunately, there is misinformation regarding working retirees. There is often incorrect information about whether working retirees can receive a second salary, whether they can receive unemployment benefits, and issues such as what happens when they get sick, are treated unfairly, are unjustly fired, or whether they can benefit from job security and reinstatement. There are also situations regarding how they can obtain their rights such as notice pay, severance pay, etc., when they are dismissed. Because there is a lot of misinformation about retirees, and many of our retired brothers and sisters are deprived of these rights.

'DOUBLE SALARY AND PROMOTION ARE POSSIBLE'

First of all, it should be stated that; if you are retired from any workplace, whether public, Bağkur, SSK, or working in the private sector, as long as you are subject to the social security support unit, you can receive both your pension and the salary you earn from the workplace where you work.

In fact, while receiving a promotion due to your pension, if your employer considers you, it is also possible to receive a promotion from the bank due to the salary you earn at your workplace. Therefore, it is possible to receive two different promotions. Indeed, this practice exists in many workplaces.

Our pension does not increase within the scope of periods for which social security support premiums are paid. However, if situations such as a work accident or occupational disease occur during this period, and you become unable to work due to a work accident or occupational disease, you can receive both your pension and the temporary incapacity allowance for every day.

In addition, if there is a state of permanent incapacity while you are working as a retiree, you have the opportunity to receive both payments by also receiving the permanent incapacity pension. If you start working again afterwards, your pension will not be cut because you are subject to the social security support unit. Therefore, you have all these rights.

CAN RETIREES RECEIVE UNEMPLOYMENT BENEFITS?

To receive unemployment benefits, you must not have any income or salary. For this reason, retirees cannot receive unemployment benefits when they become unemployed. On the other hand, if the employer has dismissed you without showing any reason, you are entitled to notice pay.

In terms of severance pay, there is no difference between a retired employee and a regular employee. While non-retired employees become entitled to severance pay by obtaining a severance pay letter from the SGK, retirees can also receive severance pay for this reason because they are already retired. Furthermore, employees can request severance pay when they leave their jobs due to retirement; retirees are entitled to the same.

Apart from this, retirees should not forget that when they are working; for example, in cases such as incomplete payment of salaries, non-payment of overtime, incomplete calculation of salaries despite working on official holidays, or incomplete reporting of insurance, the employer is obliged to pay severance pay when they leave the job.

When the employer does not make this payment, you can definitely win your rights through the courts. In cases where you are dismissed only because you are retired, if there are more than 30 employees in the workplace and you have a working period of at least 6 months, even if you win reinstatement by going to mediation first and then to court, you are entitled to receive a maximum of 4 months' wages for the periods you remained unemployed. In addition to this, if the employer does not apply even if you win reinstatement based on a court decision, a job security compensation of up to 8 months is applied.

It should also be noted that: While a social security support premium deduction of only 7.5% is made from the salary of a retired person when they work; a 14.4% SSK premium and unemployment insurance premium are deducted from the salary of a regular worker.

Therefore, since the salaries of those working as retirees will face fewer deductions compared to regular employees; whether they work for minimum wage or a normal wage, the net salary of retirees is 7.5% higher."
